Design-Build Delivery Method and its Respective Application in the Czech Republic

This Diploma thesis follows up the award of public contracts using the Design-Build method. The first part focuses on the description of individual procurement methods and their advantages and disadvantages. In addition, the basic types of FIDIC terms and connditions are compared here. The second part describes and evaluates the terms of reference for specific projects commissioned by Design-Build in the Czech Republic. There is also a questionnaire survey that examines the viewpoints, knowledge and experience of contracting authorities with this method.
Possibilities of more efficient procurement of project documentation under the new Public Procurement Act

The bachelor thesis describes the possibilities of more efficient awarding of project documentation according to the new Act on Public Procurement. The theoretical part is focused on project work in construction, quality of project documentation, Act No. 134/2016 Coll., On Public Procurement, Effective Building Investments, Building Life Cycle, Evaluation Criteria for Designer Selection, Responsibility for Project Documentation, BIM and foreign experience with reforms. The practical part deals with the design of optimal qualifications and evaluation criteria when selecting a designer.
Assessment of claims in construction projects implemented using FIDIC contract templates

The aim of this thesis is to put the liability obligations arising from the FIDIC contract templates into the context of the current Czech legislation, while uncovering potential conflict areas and evaluating the pros and potential risks arising from the use of these contract templates in the Czech construction industry. The first part of the thesis contains characteristics of all components of civil liability, defines its role in the legal and theoretical field and lays the basis for the practical conclusion in the second part, which focuses in more detail on the treatment of liability obligations under the FIDIC contracts. To illustrate these conclusions, the comparison is made on a particular narrow issue of the quantification of the claims of the parties arising from the above-mentioned liability obligations.
International contracts for supply of industrial works

This thesis aims to present the terms industrial works and industrial construction and issues relating to defining them. It furthermore focuses on summarization of characteristics and particularities of selected principal international documents, which deal with the topic of international contracts on supply of industrial works (FIDIC standard forms of contract, UNIDROIT Principles of International Commercial Contracts and Legal Guide on Drawing Up International Contracts for the Construction of Industrial Works issued by UNCITRAL) and regular parts typically contained in the international contracts on supply on supply of industrial works, especially in relation to dispute settlement and arbitration. The thesis furthermore addresses competition law issues relevant to the international supply of industrial works. Claim management in international investment developments

1 Abstract The main aim of this thesis is to analyze available information on the claim management in the international capital construction. The thesis also describes how the claim management should work and makes a comparison and evaluation of the real situation in practice. This comparison and evaluation is based on FIDIC conditions of contract available to the experts in implementation of construction projects. The thesis is divided into five chapters. The chapters deals step by step with the basic terms, the FIDIC conditions of contract, the contract price, the time for completion, the claim and the claim management. Chapter One clarifies essential terms for understanding the solved theme, the project of construction, the unification of obligations, the foreign business and the construction project organization. Second chapter deals with the FIDIC conditions of contract, which can be classified as a part of lex mercatoria, factually lex constructionis. FIDIC Conditions of Contract and their Application in the Czech Republic Resume in English The goal of this thesis is, mainly by the mutual comparison, to describe the differences between each kinds of contractual forms of FIDIC and also to put the main forms into the context of their application in Czech Republic, especially by enumeration of examples of some modifications which are made through the Particular Conditions by various public employers, including the general assessment of such modifications. The basic structure of the thesis consists of two main sections, which are split into the four chapters. Changes and claims under FIDIC commercial terms in the context of the Civil Code and public procurement law FIDIC commercial terms are one of the most popular commercial terms in construction all over the world. Its regulation of Variations and Claims during the constructions works is certainly very important for successful progress of the construction. However, in the context of the Czech Civil Code and public procurement rules, there can raise issues of applicability of such regulation under FIDIC in Czech law environment and also compliance with public procurement regulation. Large industrial works represents an interesting subject of foreign trade in which countries may have competitive advantage. These industrial works also forms a large part of the state economy. Contracts that covers such transactions are very difficult, whether due to the volume and duration of supply, and because of possible problems with funding, with the political situation at the place of delivery, etc. Contracts covering such a transactions could be very tricky to draft because of either volume and duration of supply, funding issues or political instability in the region etc. The aim of this thesis is to introduce basic concept and principles that are linked to international trade with large industrial works. The thesis is mainly focused on contracting opportunities, ie the general approaches to contracting for the supply of capital equipment. The main theme is - within the specification, form of contract for the supply of capital equipment, as well as other resources that can be used during drafting the contract, such as commercial conventions and more. This work deals with the bid price for a development project base on the construction of houses funded by a private German investor. The bid price create with help of budget in a various structures. The various structures of the budget, which use in German environment usually. Specifically, it uses the norm DIN 276 and classification StLB includes software. The main target of my diploma thesis is suggestion for create the bid price. The suggestion with choose form and manner of valuation build works, which respect all legislation for realization construction in Germany.
