62 Sedmá kapitola: Závěr Základním cílem předkládané diplomové práce je popis a rozbor platné právní úpravy rostlinolékařské péče v České republice a v komunitárním právu. Rostlinolékařská péče zahrnuje v současnosti tři základní oblasti, které jsou upraveny právem. Jedná se o opatření proti šíření a zavlékání škodlivých organismů, oblast přípravků na ochranu rostlin a oblast mechanizačních prostředků. Cílem současné rostlinolékařské péče je péče o zdraví rostlin. Tento pojem sám o sobě implikuje nejenom opatření proti šíření a zavlékání škodlivých organismů, nýbrž - a fakticky převážně - prevenci. Historický exkurz vývoje právní úpravy rostlinolékařské péče ukázal na příkladech, že se nejstarší právní úprava rostlinolékařské péče v českém i komunitárním právu týkala pouze izolovaných škodlivých organismů a boje proti nim. V československém a později českém právním řádu byla rostlinolékařská péče až do roku 1996 součástí zákonů o rostlinné výrobě. Až etapa samostatných zákonů o rostlinolékařské péči se stala výrazem změny pojetí rostlinolékařské péče jako snahy o uchování zdraví rostlin. Caves and their legal protection

This diploma thesis aims at Czech legislation related to conservation of caves both in terms of its link to the protection of caves as subterranean spaces and parts of the natural environment and of its relation to other fields of expertise, including legal studies (e.g., mining law) and other disciplines (e.g., geology, carsology). First, our attention is paid to definition of the term "cave" and to links of the term to natural sciences. Further, we analyse the development of legal conservation of caves and approaches to caves as a subject of legislation per se. The example of Slovenia - being a prominent speleological country with recognized legislation in terms of its quality and detail - is used in order to compare Czech approaches to cave conservation. Concerning the practical issues, we present an example of conservation effort devoted to one single cave in Czechia, which enables to describe functioning of legal conservation tools, including the themes where these tools overlap. We also present and discuss the only one Czech case-law dealing with the legal aspect of caves.

The Environmental Impact Assessment (EIA)

The main goal of my thesis is to provide an in-depth analysis of the Environmental Impact Assessment (EIA), which is currently one of the significant legal tools of environmental quality protection. In case any public or private project is likely to have a significant effect on the environment, it needs to pass through the EIA proceedings. This process precedes the development consent to the project. The original EU legal regulation (Council directive 85/337/EEC amended by Directives 97/11/EC, 2003/35/EC and 2009/31/EC) is described in the first part of the thesis. The main sources of this chapter are the judicial decisions of the Court of Justice of the European Communities that reflect the incorrect transpositions of the directive into the legal order of the individual member states. The second chapter is focused on specific attributes of the Czech legal regulation that is included in the legal act no. 100/2001 Sb. modified by further amendments. The regulation is divided into two parts: The first part, the assessment, is concluded by a non-binding opinion, while the second part is concluded by development consent or refusal, as based on particular legal regulations. The development of mining law

This diploma thesis deals with the development of the mining law in the Czech Republic. The thesis follows the development from the prehistory until the currently upcoming legislation. In the thesis is further elaborated the present legislation of the mining law, with the emphasis on the interpretation of the basic terminology and institutes that are minerals, mineral deposit, extraction, explosives and more.
