The Environmental Impact Assessment: - A Comparison of Legal Regulation in the Czech Republic and the Commonwealth of Australia

This research paper summarizes legal regulation regarding Environmental Impact Assessment in the Czech Republic and Commonwealth of Australia. Both these countries recently enacted amendments to the current regulation or taken steps to implement changes of this process in order to make it more efficient in term of costs of the proceedings and also in terms of more quality protection of the environment. A comparison of the legal regulation of conventional and organic farming

Resume Agriculture has intensified greatly in the last century and heavy machinery and chemical substances are being used, which causes negative impact on environment. On the other hand, organic farming tries to use natural resources with utmost care and rejects synthetic substances. The main goal of the thesis is to find and describe the most important differences of the legal regulation of conventional and organic farming. International regulation, regulation of European Union and Czech regulation are the main focus of the thesis. The first chapter tries to characterize conventional agriculture and describe its functions, briefly goes through its development and current status. Chapter deals with causes, subject and purpose of legal regulation and analyzes sources of law in the international law, European law with main focus on Common Agricultural Policy and Czech law. The second chapter is concieved similarly as the first one, but from the view of organic farming. It characterizes organic farming, describes its development and legal regulation on the international, European and Czech level. Tato diplomová práce si klade za cíl představení České inspekce životního prostředí jako orgánu státní správy provádějící dozor v oblasti ochrany životního prostředí. Česká inspekce životního prostředí byla založena zákonem č. 282/1991 Sb., o České inspekci životního prostředí a její působnosti v ochraně lesa. Postupně byla její působnost rozšířena i do dalších oblastí ochrany životního prostředí. Česká inspekce životní prostředí plní ve společnosti nezastupitelnou funkci a snahou této práce je specifikovat činnost České inspekce životního prostředí, její právní úpravu, ale také srovnání s jinými inspekčními orgány.

The thesis International Climate Change Law presents international legislation in the area of climate protection. Specifically, it focuses on the United Nations Framework Convention on Climate Change, the Kyoto Protocol and proposed legal aspects of the new agreement, which is to arise from the 21st yearly session of the Conference of the Parties in Paris. In its introduction the thesis outlines the scientific background of the climate change and political and technical approaches to its solution. Then, it gives an overview of the development of the international law in this area, including its political context. The following chapters analyse key legal documents highlighting their objective, principles, commitments, and tools. The last chapter sums ups and briefly analyses the most important aspects of the proposed legislation.
Legal regulation of the Environmental Impact Assessment (EIA) in relation to European legislation

The subject of this dissertation is the process of the Environmental Impact Assessment in relation to the respective European legislation. The dissertation aims at providing a comprehensive analysis of the current Environmental Impact Assessment legislation, including its historical, international and European contexts. The dissertation proceeds in five chapters. Chapter One outlines the general characteristics of the Environmental Impact Assessment procedure and the principles that govern it. Chapter Two examines the development of the Environmental Impact Assessment process in international law, with emphasis on the Aarhus Convention. Chapter Three focuses on the anchoring of the procedure in European law. The core part, then, is Chapter Four, which delineates the separate phases of the Environmental Impact Assessment process as defined in Czech legislation. In the last chapter, the expected changes in the concept of the Environmental Impact Assessment are sketched.
The role of municipalities in the air protection according to the new legislation

The thesis focuses on the role of municipalities in the air protection, particularly on the legal instruments of municipalities within their individual and delegated jurisdiction. The thesis consists of six chapters. The first chapter is introductory and is aimed at the air as the subject of legislation. The second chapter focuses on legislation of municipalities and other chapters describe the role of municipalities in land use, placement and approval of stationary sources of pollution. Further chapter points out specific legal instruments used in transport and the last chapter deals with the possibilities of the municipalities in relation to air pollution by individuals. Legal regulation of the protection of woodspecies

This diploma thesis deals with legislation concerning the protection of wood plants. The six chapters contained within attempt to provide a cohesive overview of this topic as a whole. Legislation in this field has undergone major changes in the recent past. The core of the thesis is an overview of the current state of legislation as it concerns wood plants growing outside the forest as enshrined in the Act on Nature and Landscape Protection. The first chapter deals with an introductory definition of what constitutes a wood plant growing outside the forest, as well as its functions. The following chapter outlines the relationship between public and private law aspects of wood plant legislation. The issue of ownership and neighbour s rights is focused on in particular. The next chapter lays out the basics of public law legislation in this field. The fourth chapter is the crux of the thesis as it deals with the protection of wood plants growing outside the forest as enshrined in the Act on Nature and Landscape Protection, especially when it comes to the possibility of felling of wood plants. - 1 - Abstract The theme of the thesis is "Development (building) procedure and environmental protection". Between the aims of this theses belongs analysis of the construction proceeding according to Building act, further especially evaluation of contemporary legal adjustment environmental protection with connection to construction proceeding and disquisition about main instruments in environmental protection. The thesis deals with environmental impact assessment procedure, objections of the participants in construction proceeding, public participation in contruction proceeding and binding standpoints. The thesis is systematically composed of three chapters. The first chapter focuses on legal adjustment and main principles of environmental protection. Chapter two describes object, subjects and particular phases of construction proceeding foccused on building authority activities. The third chapter deals with particular instruments of environmental protection in construction proceeding. Finally, the thesis comprises a summary of contained conclusions.
Legal protection of trees as landscape element

This diploma work deals with the protection of wood growing outside the forests mainly for their landscaping and esthetic functions. It is divided into three basic parts. The first part briefly reports on the history of the protection of trees in the Czechlands. The second part presents current legislation in the Czech Republic. It describes the general protection of trees, modes of tree felling and compensatory planting. The next chapter explains the special protection of trees - protected trees and the reasons for their declaration of protection. A large space is devoted alleys along roads. Next chapter deals with the protection of trees under private law. The last part od diploma work presents the Slovak legislation of this area and its comparison with the Czech.
