73 LEGAL REGULATIONS OF BEEKEEPING SUMMARY Beekeeping is one of the oldiest hobbies all aroud the world. People used to breed bees many many years ago and it caused a necessity to regulate the relationships between beekeepers and between beekeepers and the state by law. First proper beelaw originated in the time of Marie Terezie in the 18th century. Later on was beekeeping regulated in many fractional laws, but the most important was the Civil code, which we still use nowadays. This code solves the most important questions of beekeeping as the possesion of bees and lhe liabilitity of beekeepers. The codes have to protect bees on one side and also people on the other side. Bees have to be protected from different kinds of fertilizers which are often used to keep plants fresh and healthy. The planters must obey several rules and in case of breaking these rules they can be punished. If the protection of people is concerned, the beekeepers must be careful where to put their hives, so that the bees don't disturbe other people too much. - aj Excessive noise occupies a number of factors threatening our environment is an increasingly important place. It does not even reach extremely high levels, yet a negative effect on mental performance, impairs mental well-being affects the quality of sleep, or cause annoyance, because a person is forced to perceive unwanted sounds. The most important and geographically most widespread source of noise is traffic. The largest share of the total noise in the Czech Republic has the vehicular traffic, the smaller share of the load is noise from rail and air transportation. The subject of my thesis is the protection against noise, especially in outside - employment environment, which is currently considered as a very significant source of danger to human health and environment. Introductory chapter no. 2 contains the substance of the basic concepts - sound, noise, emissions and pollution of noise, vibration, further indicates the negative effects of noise on human health and suggests possible measures to reduce noise. Energy sector and the chmate change - legal aspects The topic of this diploma thesis is the relationship between the law of the climate change and the energy sector. The aim of this thesis is to describe and analyze this relationship with special focus on the differences in legal enactment of this relation in the law of the developed and developing countries. The developed countries are in this thesis represented by the Czech Republic and the European Union, respectively; the developing countries of the global South are represented by Peru and the Andean Community, respectively. The object of the analysis is the climate change law and energy sector in the international law, European law, in the law of the Andean Community, and in the Czech and Peruvian law. The research hipothesis of this work is that the developing countries, whose situation is described on the case of Peru, shall be positively motivated by developed countries to participate actively on the international climate change mitigation efforts. This positive motivation may have form of, for example, technology transfers, financial aid or investments to the projects that contribute to the reduction of greenhouse gas emissions in these countries. I have chosen the topic of my thesis "Rights and duties of the owner of agricultural land" for the following reasons. First of all I am interested in the status of the owners of agricultural land and generally in the land law. I also consider the relations concerning the agricultural land very important, because agricultural production is a needful way of food supply, hence condition sine qua non for life on Earth. The purpose of my thesis is to analyse the status of the owners of agricultural land in terms of the land law and to examine some of their present issues. The thesis is composed of three parts, each of them dealing with different aspects of the agricultural land ownership. Part One is introductory, it defines basic terminology used in the thesis and describes evolution of agricultural land ownership. It is divided into three subparts. Subpart One defines the concept of ownership in Czech legal order. Subpart Two deals with land ownership and land law. It explains specialities of land and the problems related to it. Závěr Má diplomová práce přinesla pohled na problematiku mobilních zdrojů znečišťování životního prostředí z trochu jiné pozice, a to z pozice posluchače, který se automobilům věnuje prakticky od dětství. Některým se mohou jevit podané informace faktografického a technického charakteru obsáhlé, je však třeba si uvědomit, že jejich znalostí či orientací v nich se pak snáze přistupuje k prováděcím předpisům, které stanoví konkrétní požadavky na určité mobilní zdroje. Přitom právě předpokládají posluchačovu představu o základních aspektech oblasti techniky. Je to způsobeno i povahou samotného práva životního prostředí, které se musí vypořádat s celou řadou pojmů jiných oborů, např. z chemie a biologie. Proto se ve své práci zprvu věnuji problematice základního rozdělení a definice zdrojů znečišťování životního prostředí. Přidávám i pojednání o automobilových palivech, která hlavně v poslední době zažívají nebývalý rozvoj. Alternativ k motorové naftě a benzínu je již hodně, časový odstup prozradí, jaká je opravdová možnost jejich aplikace a teprve poté se začnou prosazovat i v jiných mobilních zdrojích než v automobilech, na kterých jsou testována. Delictual liability of natural persons in environmental protection is the topic that represents the intersection of several branches of law. Passing the new penal code brings to criminal law some news in the branch of environmental protection. The purpose of my thesis is to describe the general conditions of delictual liability and then point out to the specifics of the particular types of delicts. The aim of the thesis is also to compare the responsibility for administrative offences and liability for crimes. I divided my thesis into two main parts - the general part and the special part. My thesis contents fourteen chapters, which are dealing with different problems of liability in environmental protection.

67 Legal regulation of beekeeping No bees, no plants. Beekeeping is a nessesity, which warrants quantity and quality of agricultural production, that is why this section regulated by law. There is no special apicultural act in Czech republic. Legal regulation of beekeeping is divided into a few branches. Provisions, which are related to beekeeping are involved in Civil Code, Veterinary Act, Plant medicine Act, Foodstuff Act and so on. Most of provisions are involved in implementing regulations. Civil Code No. 40/1964 is concerned with statutory questions of a civil law, as a proprietary law, neighbour's rights and damages with beekeeping. Most frequent problems which the Civil Code deals with, are disputes between two neighbours, when the first one, who is afraid of bees asserts, that the other neighbour's beekeeping interferes with his owner's freedom, because he can't use his property. He may for example be allergic to bee stings. Civil jurisdiction answer the question what is a bee bothering and when is it adequate or unadequate. There are a few crimes possibly concerned with beekeeping, grounded in Criminal Code No. 140/1961. It might be felony theft, destroying another's property, and environmental leopardy. 62 Sedmá kapitola: Závěr Základním cílem předkládané diplomové práce je popis a rozbor platné právní úpravy rostlinolékařské péče v České republice a v komunitárním právu. Rostlinolékařská péče zahrnuje v současnosti tři základní oblasti, které jsou upraveny právem. Jedná se o opatření proti šíření a zavlékání škodlivých organismů, oblast přípravků na ochranu rostlin a oblast mechanizačních prostředků. Cílem současné rostlinolékařské péče je péče o zdraví rostlin. Tento pojem sám o sobě implikuje nejenom opatření proti šíření a zavlékání škodlivých organismů, nýbrž - a fakticky převážně - prevenci. Historický exkurz vývoje právní úpravy rostlinolékařské péče ukázal na příkladech, že se nejstarší právní úprava rostlinolékařské péče v českém i komunitárním právu týkala pouze izolovaných škodlivých organismů a boje proti nim. V československém a později českém právním řádu byla rostlinolékařská péče až do roku 1996 součástí zákonů o rostlinné výrobě. Až etapa samostatných zákonů o rostlinolékařské péči se stala výrazem změny pojetí rostlinolékařské péče jako snahy o uchování zdraví rostlin.
