Machoňová Schellongová, Ivana ; Šturma, Pavel (advisor) ; Hofmannová, Mahulena (referee) ; Válek, Petr (referee)
1 Reservations to international human rights treaties Abstract Reservations to human rights treaties have been focus of theory and practice of international law for many years. While the Advisory Opinion of the International Court of Justice on the Reservations to the Genocide Convention and the Vienna Convention on the Law of Treaties set key parameters for making reservations to international treaties, in particular criteria of compatibility of reservations with the object and purpose of a treaty, many questions remained unanswered. A question whether the regime of the Vienna Convention of the Law of Treaties is appropriate for international human rights treaties, due to the special character of the later, raised to heated debates. Authority of treaty bodies, e.g. committees monitoring implementation of these treaties by their States parties, to decide upon compatibility of reservations with object and purpose of these treaties and consequences of such decision, has been discussed. In the meantime, the treaty bodies, as well as the regional courts, developed a rich jurisprudence in this respect. Finally, the International Law Commission analysed the issue of reservation thoroughly over 18 years, leading to adoption of the Guide to Practice on Reservations to Treaties (2011) clarifying most of the...

Settlement of Stroked Pottery Culture at Čelákovice
Válek, Petr ; Popelka, Miroslav (advisor) ; Burgert, Pavel (referee)
This presented thesis summarises findings from a rescue excavation at the site Čelákovice - "V Rybníčkách" (dist. Prague - East), with an emphasis on the trans-regional contact in the form of the Bavarian Jurrasic chert. The field research has been conducted by Municipal Museum in Čelákovice in summer 2011 due to the construction of a trade centre by the firm Tesco. In the area of 1,4 ha was uncovered a total of 86 features belonging to the stroked pottery culture (StK). Features were mostly constituted of longhouse postholes, further bigger pits and loam pits. They contained more than 6000 ceramic fragments mostly of cauldron- and beaker- shaped vessels, dated on the basis of ornamentation to the younger phase StK IVa. There was also found a large number of chipped and polished industry (450 and 456 artefacts), concentrated mainly in three sunken features interpreted as workshops. Production activity is proven beside fragments of the blades and flakes also by different kinds of sandstone abraders as well as drilling cores. The most important raw material in the collection of chipped industry is represented by the silicite from glacigenic sediments (48 %) and Bavarian Jurrasic chert (38 %). This chert was imported to the locality from about 250 km remote mining site at Arnhofen through the...
The Still evolving Principle of Universal Jurisdiction
Baumruk, Petra ; Šturma, Pavel (advisor) ; Bílková, Veronika (referee) ; Válek, Petr (referee)
The present study describes the nature, scope and application of universal jurisdiction as an important tool against impunity in international criminal law, in a straight forward manner, where inquiry into the recent developments of universal jurisdiction is undertaken. Forthwith, the formation of the principle of universal jurisdiction - especially its practical application - must be guided by international consensus, not through advocacy action of states with short term and narrow objectives. The thesis seeks to identify and observe how far the law of universal jurisdiction has actually evolved and how far we should expect it to evolve in the near future, considering its restrains and challenges. It is argued that the concept of state sovereignty, which constitutes the greatest impediment on the exercise of universal jurisdiction, has seen various changes to its fundamentals elements in the 21st Century. The aim is to look at the universality principle, not as an isolated part, but as part of a broader framework in modern international law and thus special attention is given to the relationship between universal jurisdiction and the principle of aut dedere aut judicare. These principles are interrelated, yet distinct, parallels in deterring commission of the most heinous offences of international...
