Principles of protection of the environment and their application in international, European Community and Czech law

ENGLISH SUMMARY: This thesis, called "Environmental Principles and Their Application in International, European Community and Czech Law", is concerned with the problems of environmental principles as part of legal order. The special nature of environmental law implies the specific attributes of these principles. My task is to demonstrate and to give reasons for these special features. It requires previous investigation into their relation to the universal definition of the concept of "principle". I have used the comparative and teleological method with a view to contribute towards understanding the sense of environmental principles as instruments of the environmental protection The thesis is composed of two parts, each of them is dealing with different approaches: The opening part introduces a specific branch of law - the environmental law and shows what its primary purpose is and circumscribes the object of protection. The following chapter focuses on the sources of law and points out that the principle can be regarded as independent source of law. 104 Abstract in English Územní plánování jako nástroj ochrany životního prostředí Town and country planning as an instrument of environment protection Together with atmosphere and water, the solid part of the Earth's surface (soil) is one of the constituents of the environment. Proper environment is an essential condition for the existence of human life, and not human life only. Building a construction or facility in an area results in significant changes of the environment. The more densely an area is populated, the more significant are the changes of the environment regarding the quality of human life. The town and country planning, according to Czech law, is a complex mechanism which makes provisions for placement of constructions and facilities. Procedures (actions) making up the mechanism of town and country planning can be divided into two stages. In the first stage, legally binding concepts (plans) are created. In the second, decisions on the placement of particular constructions and facilities are made, in accordance with the authorized concepts (plans). With respect to the above-mentioned, the environment needs to be sufficiently protected during both stages. Summary/Key words 80 SUMMARY Waste management principles The main purpose of this thesis is to analyze practical application of legal principles in waste management. This topic was chosen based on the publication of new Waste Framework Directive which newly deals with the issue of principles in the waste management. Fundamental principles that are being introduced in the Directive are waste management hierarchy, proximity principle, self-sustainability principle, extended polluter responsibility. The thesis is composed of five main chapters, each subdivided into several sections. First chapter introduces reader into the aspects of legal principles and describes basic characteristics of the principles, its function and points out legal theories which have occurred in the past. Introduction chapter also deals with the question of difference between legal regulation and legal principle. Following part of the introducition outlines legal regulation of waste management, as it is initial point for understanding of further sections. The third chapter is devoted to the fundamental principle of waste management, waste management hierarchy.
