Liability of employer for damage resulting from occupational injuries and illnesses

Employer's liability for occupational accidents and diseases The purpose of my thesis is to analyze contemporary legal regulation of employer's liability for occupational accidents and diseases in comparison with its former regulation in labour code from 1965. The thesis is composed of seven chapters. Chapter one is introductory with focus on liability for damage in labour law. In the beginning of this chapter the thesis deals with the division of liability for damage into employer's and employee's liability. The first subchapter brings a brief characterization of contemporary legal regulation of employer's liability for occupational accidents and diseases. The second subchapter concerns with mutual relationship between civil code and labour code and the use of civil code in labour law. In the chapter two, you can find a description of terms occupational accident, damage and causality between occupational accident and damage, which are necessary preconditions of employer's liability for occupational accident. Welfare of the elderly and the pension reform in European countries

The diploma thesis describes and analyses the current pension system in Czech Republic, including other allowance possibilities of Czech seniors. System's imperfections and their possible reformations are emphasized. Opening part is devoted to the historical development of old age security and constitutional and international basis of the current legal regulation. The second part aims at the pension reform in Czech Republic. Demographic information and main problems of the current system are analysed. Political reform concepts are briefly described and they are reviewed in context. Next, the thesis deals with the pension reform itself and describes changes which have already been done and measures to be taken. Finally the old age security and pension reforms in three different European countries are compared. The countries were selected as the representatives of the three different social state models.
Reconciliation of work and family life - reflection of the European law in the activities of the Czech government

The problem of reconciliation or work and family life has been of cardinal importance over the past few years not only in the Czech Republic but in most European countries. For most families it is becoming more and more difficult to reconcile the duties connected with the care of children and other dependent persons with the occupation. This situation is caused by many factors such as the growth of women employment, changes in family structure, demographic effects, development of human rights and many others. Social policy must take these aspects into account and carry out such acctivities that will enable families to face the challenges of the present society and won't make them decide either work of family. As a part of theory there are quite many particular methods and ways how to help families to cope with their employment and family duties. Some sources distinguish these strategies among individual and family, employers' strategies and strategies of the welfare state. But the European states differ as to how they view family and social policy as well. 55 English resumé : Social welfare state - historical and theoretical origins The name of this work in English is a bit misleading because Czech language has no perfect and widely acceptable equivalent for the English term "welfare state". The work is focused mainly on legal aspects of a social welfare state and its historical and theoretical origins in tle area of the nowadays Czech republic. In tle first part I attempted to chart the works of great Czech social thinkers, representatives of so called Czech social school. Works by Albín Gráf, T.G. Masaryk And especially Karel Engliš established the basics of social doctrine of so called first republic. Works of these thinkers were followed by other representatives of czech social school Lev Winter, Emil Schönbaum, Alois Rašín and others, who were the implementers of this doctrine. Czech social school created for that time very modern social legislation, which brought the new state esteem and respect of the whole world. Social services and the role of non-governmental organizations in social security

Social services are an important part of the system of social assistance. The object of social services is to help citizens in unfavourable social situations regarding their health, age, handicap or other serious grounds, if they can not solve their situation themselves. The services aim to maintain the highest possible quality and dignity for their clients. Social services provide meals, accommodation, assistance with bridging unfavourable social situations, care for people with a limited ability in the area of personal and home care, assistance with bringing up a children and also social counselling. The providing of social services was regulated by the social services act number 108/2006 Sb. This act shows actual trends that are similar in the whole Europe and brings a new approach to social services. Organization and control over this area of work belongs to the ministry of labour and social affairs in cooperation with regions and municipalities. This thesis focuses on the position of providers of social services after the adoption of the above social services act. The social services can be provided by for example organizations created by regional or local authorities, organisations such as citizen association, churches and citizens.
