Consumer protection on financial markets

This thesis focuses on the description of the main principles and instruments of the consumer protection concept on the financial market of the Czech Republic. It aims to justify the legitimacy, assess the efficiency of the concept and evaluate the extent to which consumer protection is provided. An extensive part of the text is devoted to a detailed specification of the legal term "consumer". Czech legal framework is the primary source for the text. Applied methods are interpretation of Czech legal standards and a description of specific selected instruments that are followed by general deductive implications. The conclusions of this paper are suggestions concerning the efficiency of certain instruments and the determination of a sphere, where consumer protection should be strengthened.
Collection of the debts out of consumer credits

The Bachelor thesis describes the whole process of collection of debts from the first day of the debtor's delay with paying-off, risk loan origination and running of out-of-court collection in the bank to eventual collection in the execution proceedings, whereas the main part of the thesis has been focused on the judicial proceedings. The thesis practically describes especially the real procedures used in solving risky and hardly enforceable debts in the banks as well as by collection and law offices specialized for this type of work, and also explains the relations between these subjects. The reader should understand, why the sides are acting in particular situations in the described way and not differently. This thesis has been written to be used as a practical manual for banks, collection offices and their employees or potential creditors, who are interested in buying some claimes. The possible debtors on the other hand can get to know some methods, which could be applied to minimalize the negative results connected with their financial shortcoming and unability to pay.
Development of consumer credits in the Czech Republic

It analyzes the legal adjustment of the product, compares the previous law of 2001 with the new Consumer Credit Act in force since 2011. Introduces with credit risk and its management method. The central part of the work deals with the development of banking and non-banking consumer loans in the Czech Republic. Finally,there is a comparison of market in the Czech Republic, the Slovakia and the FRG.
Consumer credits and tools used for their comparison

This bachelor thesis deals with consumer credits. It aims to familiarize potential applicant for the consumer credit with fundamental information and facts which are necessary for orientation in these broad problems. At the beginning, new law, which came into force in January 2011, is analyzed in detail. That is followed by an introduction of methods of classification of consumer credits with emphasis on mutual differences between particular types. Principal part focuses on methods of assessing and comparison of advantages of consumer credits by means of interest rate, rate of increase and annual percentage rate of costs. Finally, particular bank and non-bank credit offers are compared by using above mentioned tools of evaluation of the profitability of credits.

The aim of the thesis is to present various types of consumer credits provided by sales finance companies offering instalment sales, and to compare them with loans granted by banks. Special attention is paid to the companies GE Money Multiservis, CETELEM ČR, a. s., Home Credit, a. s., ESSOX, s. r. o., and COFIDIS, s. r. o., focusing on their instalment selling terms and conditions. The banks institutions are represented by purpose and non-purpose loans offered by Česká spořitelna, a. s., Komerční banka, a. s., and Poštovní spořitelna.

It presents various types of consumer loans offered by Czech banks and non-banking institutions. Readers are familiar with the need for credit risk management. There are the current client information registers in the Czech Republic presented. It aims to compare the evolution of the volume of consumer loans in the banking and non-banking sector in recent years. It also examines the impact of financial crisis on this market.

Thesis is focused on consumer loans. On the introduction I described the division of loans, the personal bankruptcy, what it means to identify the client, the difference between APR and interest rate, what does the loan application and loan agreement. Further steps are described in outstanding loans as personal bankruptcy and consolidation loans. Followed by credit registries, their role in providing loans and debt developments in the Czech households. Finally, the chapter is devoted to the harmonization of laws on consumer credit in the EU and the conclusion is included a chapter devoted to lending practices.
The bank klient and his protection in Czech system of law

The diploma work is concerned with the topic of bank client security, as a consumer and an investor, captured in the Czech law, incorporating elements of EU directives. The thesis defines terms of "consumer" and "investor", explains why they are considered bank clients and introduces reasons of their protection. It describes elements of bank clients' protection such as: deposit insurance (including comparison of foreign systems - Switzerland and New Zealand), consumer credits rules, payment system and Bureau of Financial Arbiter, personal information security and bank secret. The last chapter addresses investor protection, falling under European directive MiFID (Markets in Financial Instruments Directive).
