Bakalářská práce popisuje celý proces vymáhání pohledávek již od prvního dne prodlení dlužníka se splácením, vzniku rizikového úvěru a průběhu mimosoudního vymáhání na půdě banky až po eventuální vymáhání dluhu v řízení exekučním, přičemž hlavní část práce je věnována soudnímu nalézacímu řízení. Celá práce je pojata tak, že prakticky popisuje zejména reálné postupy při řešení rizikových a obtížně vymahatelných pohledávek jak na půdě bankovních subjektů, tak především u inkasních agentur a advokátních kanceláří, které se na tuto práci specializují, a také vztahy mezi těmito subjekty navzájem. Čtenář této práce by tedy měl porozumět, proč strany v průběhu jednotlivých fází postupují právě popsaným způsobem. Tato práce může sloužit jako praktická příručka pro banky, inkasní agentury a jejich zaměstnance nebo potencionální věřitele, kteří by měli zájem o odkup pohledávek ze spotřebitelských úvěrů. Případní dlužníci se naopak v této práci mohou dozvědět o některých postupech, které lze aplikovat za účelem minimalizace negativních důsledků spojených se svojí finanční tísní a neschopností splácet. The Bachelor thesis describes the whole process of collection of debts from the first day of the debtor's delay with paying-off, risk loan origination and running of out-of-court collection in the bank to eventual collection in the execution proceedings, whereas the main part of the thesis has been focused on the judicial proceedings. The thesis practically describes especially the real procedures used in solving risky and hardly enforceable debts in the banks as well as by collection and law offices specialized for this type of work, and also explains the relations between these subjects. The reader should understand, why the sides are acting in particular situations in the described way and not differently. This thesis has been written to be used as a practical manual for banks, collection offices and their employees or potential creditors, who are interested in buying some claimes. The possible debtors on the other hand can get to know some methods, which could be applied to minimalize the negative results connected with their financial shortcoming and unability to pay.
