Risk Management in Personal Data Protection

The bachelor thesis focuses on the issue of the risk management in the context of personal data protection in the course of the implementation of their processing. Concerning the theoretical background, based on the explanation of relevant parts of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the own methodology for risk management in personal data protection is presented. The thesis also attempts at interpretation of some general expressions, understanding of which is indispensable for the specification of the main issue, such as a risk and the process of risk management itself. The practical output of this bachelor thesis is a web application providing the determination of the severity of the risk to the rights and freedoms of data subjects in the process of the general risk assessment for personal data processing operations.

Personal data protection before and during the establishment of the employment relationship The diploma thesis is devoted to personal data protection before and during the establishment of the employment relationship. The objective of this thesis is to outline the personal data protection in the context of the employment relationship establishment, to give a comprehensive overview of its legislation in particular, describe the basic terms and principles relating to this subject matter and specify the most important rights and obligations regarding both stages of the employment relationship establishment. The basis for the thesis is primarily the legislation of the General Data Protection Regulation and Personal Data Processing Act 2019 (No. 110/2019 Coll.). The diploma thesis is divided into four chapters. The historical events with a significant influence on the personal data protection development are described in the first chapter. This chapter also explains the concept of a right to privacy and separation of the right to protection of personal data from it. Employer monitoring of employees - Monitoring of Flexible Work Arrangements Abstract This thesis focuses on three areas of interconnected legal issues, institutes, and topics that all come together within the scope of labour law and the actual industrial relations. The first area covers the protection of privacy and integrity of the individual as stipulated by the constitutional standards, general legal regulations, European standards, and binding international treaties and conventions. The second area covers the industrial relations as such; however, special emphasis is put on the protection of privacy and integrity of employees. Finally, thethird area covers the employee monitoring by the employer - at theusual workplace as well as when working remotely, usually from the employee's home. In the introductory part, the above mentioned sources of law are analysed and the normative framework is described, setting the limits of legitimacy and legality of employee monitoring by the employer. Monitoring of employees in context of General Data Protection Regulation

1 Monitoring of employees in context of General Data Protection Regulation Abstract This diploma thesis focuses on the supervision and monitoring of employees from multiple perspectives. Based on the relevant European and national caselaw the thesis specifies whether employees shall have right to the protection of their privacy and integrity at the workplace. Thesis also analyses selected aspects of personal data protection with emphasis on personal data of employees as data subjects processed by employers as controllers. In particular attention is devoted to selected obligations, which arises from General Data Protection Regulation for such personal data processing in the light of relevant statements and guidelines provided by the European Data Protection Board, Article 29 Data Protection Working Party and the Office for Personal Data Protection. Thesis in detail addresses the supervision of employees carried out by § 316 of the Labour code, whereas interprets its provisions as well as conditions for establishing the supervision of employees arising from such interpretation. Rights and obligations of the employer as a data controller

This diploma thesis deals with the topic of personal data protection, and focuses particularly on the duties of the data controller, which also largely apply to the employer as the controller of the personal data of the employees. The diploma thesis builds primarily on the legal regulation of personal data protection contained in GDPR, while in some sections, a comparison with the previously effective personal data protection legislation is included. The objective of this diploma thesis is to provide a comprehensive overview of fundamental personal data protection institutes from the data controller's point of view with a focus on the analysis of some of the obligations which has been newly introduced by GDPR. The diploma thesis is divided into four chapters, which are further divided into a relatively high number of subchapters.
