Kanický, Jakub ; Žákovská, Karolina (advisor) ; Sobotka, Michal (referee)
Legal Regulation of the Placing of Hazardous Chemical Substances and Mixtures on the Market in European Union Environmental Law Abstract: The aim of the thesis was to explore the main features of the legal regulation of the placing of hazardous chemical substances and mixtures on the market in European Union environmental law, namely those features which significantly affect the achievement of a high level of protection of human health and the environment. In order to fulfil this aim, two regulatory regimes governing the placing on the market of substances and mixtures were analysed: a general one, mainly represented by the REACH Regulation (No. 1907/2006) and the CLP Regulation (No. 1272/2008), and a special one, where the Plant Protection Products Regulation (No. 1107/2009) was the object of analysis. The thesis first deals with general issues of the regulation of hazardous substances and mixtures: the role of private and public law, the phenomenon of the so-called proceduralisation of environmental law and the definition of basic terms (including a detailed analysis of the concepts of hazard, hazardous properties, risk and related terms). This general part is followed by an analysis of the most important legal institutions contained in the mentioned legislation (notably registration, evaluation,...
Legislation of handling of special sources of danger to the environment
Michálková, Tereza ; Stejskal, Vojtěch (advisor) ; Pekárek, Milan (referee) ; Sobotka, Michal (referee)
Thesis "Legislation of handling of sources of danger to the environment" Abstract The thesis deals with material sources of danger to the environment in terms of legal forms of environmental protection from negative impact of these sources. The topic was narrowed at the beginning of the thesis to waste and chemicals so now it represents these two huge and significant groups of threats to the environment. The reason to narrow the topic was existence of a very large scale of different sources of environmental danger and that could cause shattering of the topic during writing the thesis. The thesis describes in individual chapters various forms of waste and chemicals handling in mutual relationship with legal obligations of subjects of law. The thesis at the same time attempts to evaluate valid legislation in terms of sufficiency of legal obligations and whether these obligations are clear and specific enough to enable high level of protection of the environment and human health (at least). Czech waste management legislation is massively influenced by directive of European union waste law, so the thesis compares intention of union legislator (if it is available) with the results of czech transposition. The waste and chemicals handling chapters are connected with supporting chapter about various forms of legal...
Agroterorism
KOLÍNOVÁ, Zuzana
This thesis deals with the issue of agroterorism. The aim is to assess whether this mode of attack is a threat to the Czech Republic. First, the term terrorism, its types, methods, history and statistical overview of the attacks are defined. Furthermore, the thesis is focused on agroterorism, its definition and ways of implementation. Contamination of food, water, livestock infections can be the target of terrorists to cause panic and paralyze society. Contamination can be done using a variety of commonly used chemicals such as pesticides, herbicides, industrial chemicals, petroleum products, zoonoses, and common infectious diseases. The results analyze and elaborate in detail the specific situation of agroterorism in the Czech Republic and the possible crisis scenarios describe how the Czech Republic could be threatened. The discussion contains a summary of all the knowledge, there is a reflection on the research question, its answer and the most probable possibility and method of attack. Agro-terrorist attacks have the disadvantage that their identification, extent and origin can be difficult to ascertain, or this finding may take a long time. Often, this is a low-budget mode of attack. During the detection of the causes and the agents of the disease, other people are infected and the destruction of the devastating consequences is more demanding and even more protracted. In this way, attacks can cripple or kill a large number of people over a very short period of time. Detecting the identity of attackers can be lengthy, as attacks can be carried out in places other than the real threat. The biggest problem in the field of agro-terrorist attacks for the Czech Republic is the impact of the agro-terrorist attacks in another country, with even unintentional overlapping with neighboring countries. Such an impact may be the import of contaminated food.
