Viniculture and wine-production from the legal point of view

The title of the thesis is "Viticulture and winemaking from the legal point of view". The purpose of my thesis is to analyze the Czech legislation of viticulture and winemaking. It is important to include the law of the European Union because it directly regulates the national legislation. The aim of this thesis is to give a complex insight into the valid viticulture and winemaking law. The thesis is composed of seven chapters, each of them dealing with different aspects of the topic. The first chapter is introduction and provides only starting point of the thesis such as terminology. Chapter two is subdivided into six parts and surveys historical background of viticulture and winemaking in the Czech Republic. Each part is devoted to one important era starting in antiquity and explores the evolution till current situation. Chapter Three shows viticulture and winemaking law in the context of the Czech legal system and highlights links between mentioned law and environmental policy. Chapter Four characterizes current EU legislation and focuses on regulations concerning common agricultural policy in the sphere of viticulture and winemaking. 80 12. Summary My master's degree thesis discusses the food law of the Czech Republic and comparatives with the food law of Ireland. I have chosen this topic, because, I think, that this topic is very interesting and very important for all our life. Everyone has to eat and drink anything every day, but nobody wants to be taken ill by some illness from contaminated food, and therefore the main purpose of food law is to ensure food safety and protect health of consumers. Firstly this thesis is concerned with history of food law in the Czech Republic and The European Union. History of Czech food law began in the early 20the century. This period was very successful for food law. Next chapter deals with basic principles of European food law and the most important documents and regulations. At the present, The European Union has got a main role in the European food law and EU consolidates this law within EU and it wants to ensure food safety, animal health, animal welfare and plant health. Resumé Právní úprava ochrany dřevin Tato práce se zabývá problematikou právní ochrany dřevin rostoucích mimo les. Okrajově je předmětem této práce i problematika právní ochrany lesa. Autor se ve své práci zaměřuje na praktické otázky zkoumané materie, s ohledem na své praktické zkušenosti a navrhuje některá dílčí řešení. Prioritním cílem autora není vyhledání všech problémových ustanovení, která se dotýkají zkoumané materie, ale posoudit úroveň právní úpravy v globálním měřítku. Blíže se zabývá těmi nedostatky, které považuje za závažné z pohledu předmětu ochrany a pokouší se o odstranění těchto nedostatků vlastními návrhy, případně zahraniční, konkrétně slovenskou legislativou, která z globálního pohledu upravuje zkoumanou problematiku v některých případech efektivněji a může tak sloužit jako inspirativní vzor pro Českou republiku. Disertační práce Právnická fakulta, Univerzita Karlova v Praze 1 SUMMARY The purpose of my dissertation Delictual Liability of Legal Persons within Environmental Protection is to obtain a correct idea of how the legislation on the corresponding materia de lege ferenda should be examined. This requires to summarize, analyse and evaluate national regulations in force of delictual liability of legal persons within environmental protection as well as to compare some aspects of national regulations in force of delictual liability of legal persons with corresponding foreign regulation. A significant part of threats and damage to the environment comes from the activities of legal persons. A percentage of legal persons responsible for unlawful impairment and endangering of the environment increases significantly. Establishing legal persons is often associated with the effort of individuals to avoid liability for criminal activity by committing illegal activities through a legal person. Crime in the area of environmental protection is often perpetrated by criminal organizations with a strong financial background. Plant and animal breeding from the legal point of view

78 Abstract The goal of this diploma thesis is to clearly summarize the legal regulation in fields of the livestock breeding in the Czech law system. The thesis focuses on the elaboration of the legal regulation in pig breeding; a separate chapter is devoted to this topic. In order to give a complex overview of the breeding discipline, this thesis describes its history as well. Since 1940s, in all developed breeding countries, the livestock breeding discipline follows breeding programs supported by the genetic science. In the broadest notion, by the breeding discipline we recognize the set of zootechnical-organizational and economic measures which lead to general improvement of the livestock yield, determined by the economic yield of the breed. The basic resource of the breeding legislation is the statue 154/2000 Col., about breeding and livestock registration. Environmental protection instruments in Czech law

This diploma thesis deals with the instruments of environmental protection which are used in the Czech legal system. Thanks to these instruments, the state and other institutions try to assign the most effective environmental protection possible. We can divide these instruments into two main categories, direct and indirect. The direct instruments are divided into conceptual, administrative - law, vindicatory and voluntary. The indirect are represented by the economic instruments, which can be divided into instruments of positive and negative stimulation. The thesis also contains specification of the particular basic principles of the environmental protection and the concretization of the institutions responsible for the protection. Each chapter also contains a demonstration of how each particular group of instruments can be practically applied in the nature and landscape protection.
Bioproducts and their legal regulation

Sowohl der europäische, als auch der tschechische Markt für Bioprodukte wächst, und mit ihm auch die Anzahl der Kennzeichen, Logos und Versprechen, die im Verbraucher den Eindruck von ökologischer Verträglichkeit oder Nachhaltigkeit erwecken sollen. Diese Arbeit hinterfragt den rechtlichen Rahmen der Bioprodukte und überprüft dementsprechend, welche Regelungen auf dem Gebiet schon bestehen, auf welche Gebiete diese sich beziehen und, ob diese Regelungen in der Praxis wirklich genügen. Gerade, weil auch der tschechische Verbraucher immer mehr Kaufentscheidungen von Kriterien der Nachhaltigkeit und seinem Umweltbewusstsein abhängig macht, ist das Thema rechtswissenschaftlich sehr relevant. Diese Arbeit analysiert die europäische Regelung, hauptsächlich die "Ökologische Landwirtschaftsverordnung", aber auch die nationale tschechische Regelung, das "Ökologische Landwirtschaftsgesetz", da die Gestaltung des Kontrollsystems der Produkte und andere organisatorische Regelungen den Mitgliedstaaten überlassen werden. Delictual liability of natural persons in environmental law

The number and hazardousness of human activities that breach environmental law now features serious and growing problem. The environmental liability, that represents effective legal instrument, includes delictual liability and liability for environmental damage. The purpose of dissertation is to analyze and describe the present legal regulations of the delictual liability of natural persons in the field of environmental protection. The final aim is to propose recommendations de lege ferenda. The introductory part of dissertation defines the basic concepts like legal and environmental liability and basic priciples of environmental protection concerning delictual liability. Than it provides describtion of regulation of liability in international documents and in European Union law. The dissertation is analyzing in detail the administrative and criminal liability in Czech legal order. Natural persons are liable in Czech legislation in case of lighter breach of law for offences and other administrative delicts or in more important cases for environmental crimes.
