Legal Regulation of International Trade in Endangered Species

The purpose of the thesis is to describe international, EU and Czech wildlife trade laws by identifying the regulatory measures established at these levels of law and examining them from the perspective of each. It further seeks to analyze how CITES obligations governing these measures are incorporated into the EU and Czech legislation and investigate whether they are likely implemented inadequately or, conversely, more strictly. Additionally, it points out some of the potential problems of the current legal framework as well. The thesis is composed of six chapters. Chapter one explains the goals of environmental policy in the area of nature conservation and biodiversity protection related to wildlife trade and reasons for the very existence of its regulation. Chapter two is concerned with general aspects of wildlife trade law such as its objective, purpose, principles and role within environmental law. Chapter three outlines the main and also some other relevant sources of law. Chapter four determines the principal regulatory measures which are contained within the legal regime in order to enable it to achieve its objectives. The legal adjustment of the conditions of the recultivation of the surface mines

Thesis describes the region of Karlovy Vary region and mining history in it. Further described the legislation governing the processes of rehabilitation of controls both at the level of the statutory regulations and the regulations of the secondary. Next to them were discussed and the resolution of the Government which affect the financing of the landscape caused by damage in the time before the privatization of the coal companies. Brown coal mining in the region, Sokolovská pans after World War II, was carried out by opening the large surface mines, and stifle mining underground mines. Mining and quarrying of surface mine means a significant intervention in the entire countryside. Excavation occurs in the mining pit, the material itself bearing raw materials (overburden) is extracted and is stored in the vicinity of the pit. In place of the originally flat landscape appears the pit and near the artificial Hill. Surface mines not just speciality Sokolovská coal basin. Much better known and more are mines on Chomutov region, and in particular the Most region. There was the most devastating effect of such mining on landscape and the environment at all. The thesis is focused on the theme, which is current almost every time, even in every state, and that is the protection of the nature. We all are a part of the nature, which is all around us. It must be protected, so as future generations can experience its beauty. The interest in the theme results from the author's job that is why the author decided to discuss the theme and outline its difficulties. The work itself is divided into three parts. Most of the first part focuses on the specific territorial nature and landscape protection, which consist in announcing various categories of specially protected areas; it also focuses on the providing tools for their protection and care. In the thesis, general territorial nature and landscape protection are not omitted, because they, using certain institutes, provide significant protection to the fragments of nature or territories, which do not attain such values to be declared as protected. The diploma thesis deals with the legal regulation of the treatment with wild animals. It compares different terms used in legal regulation of protection of animals. It specified differences between concept of an animal in private law and public law. The diploma thesis is focused on possibilities of gaining ownership to the wild animals, proving origin of animals bred in human care. It concerns with legal regulation of treatment with handicap animals. The diploma thesis analyzes preparation and realization of Action and Management Plans and is also concerned about protection of wild animals against cruelty.

European legal regulation of sustainable fishing

Paper analyzes the EU legal regulation of fishing. Specifically, it focuses on activities and norms, aiming to make european fisheries become sustainable and environmentally friendly. The paper summarizes the development of the common fisheries policy (CFP), which is one of the EU sectoral policies. Emphasis is placed on latest reform of CFP, which aimed among other things to sustainability. The next part deals with individual management tools, which is controlled amount of inputs and outputs to / from the fishing process. To restriction of outputs (amount of fishery products) is used setting total allowable catches and quotas. To restriction of inputs is used reduction of fishing capacity of vessels, which given to the assign rights and available resources is excessive, and also by reducing fishing effort. In addition to these tools are an inportant technical measures serving to reduce the impact of fishing on marine ecosystems, and in particular the prohibition or restriction of non-selective and destructive fishing techniques, or delimitation areas or periods in whitch fishing is prohibited. Delictual liability of legal persons in environmental protection

This thesis deals with both categories of delictual liability of legal entities within the environmental law. The aim of this thesis is the analysis of the terms of delictual liability of the legal entities and evaluation of the effective legal regulation with emphasis on the environmental protection. Legal entities in the Czech Republic are subjects of administrative liability for a long time, while criminal liability was set by adopting the act of No. 418/2011 valid from 1st January 2012, dealing with criminal liability of legal entities and its related proceedings. The thesis is divided into five chapters. The first chapter describes the basic terms which this thesis works with and are necessary for understanding the issue, such as environment, environmental law, legal liability and legal entities. Second chapter deals with sources of law, firstly national law, then EU legislation and at the end international law. The third chapter is focused on administrative liability, its institutes and its formulation in chosen environmental acts. The thesis examines the alterations in the attitude of the UN conferences towards the environmental protection from the perspective of international law. It presents developments and changes in international environment protection in articulation with its fundamental milestones being the UN conferences in 1972 in Stockholm, in 1992 in Rio de Janeiro and in 2002 in Johannesburg. These and other conferences, adopted international documents and treaties that comprise the contemporary framework of the protection of the environment. The thesis explicates the key concepts of the environmental law, describes the role of the UN and other international organizations and summarizes the most significant conferences, events and documents. It concludes with prospects of the future development of the international environmental protection.

Rights and duties of the owner of the forest This diploma thesis deals with the legal regulation of rights and duties of forest owner and defines the basic terms related to this topic. The thesis consists of seven parts, whereas chapter one is introductory and chapter nine is conclusion. Chapter Two deals with the basic information of the history of the forest legislation. Chapter Three pays attention on the forest in the Czech republic and provides a describtion of different forest types located in our territory. Chapter Four provides legal definitions of basic terminology. Chapter Five mentions the ownership of forest owners and restrictions of their property rights. The main attention is paid to chapter Six and Seven, which include a summary of the most important rights and duties with which the forest ownership is undoubtedly associated. Chapter Eight deals with the liability of forest owner and sanctions, that may be required. The aim of my thesis is to focuse on rights and duties of forest owner within forest inventory etc. The main source of this work is the Forest Act.
