Consequences of a breach of duties by participants in highway traffic

Resumé This thesis deals with legal consequence of road users who violate their duties in road traffic. Intensity of road traffic permanently increases. Almost everyone participates in the road traffic day by day. Among the participants occur many dangerous and egoistic individuals, who do not observe the road traffic regulations. Theirs irresponsible behaviour often results in car accidents and damage to person and property. One of means to improvement of the road safety is efficient punishment of driving offences. I have divided my thesis into introduction, five chapters and conclusion. The introduction briefly introduces the problematic. In the second chapter I have paid attention to definition of terms "road user", "duties of road users in traffic" and "legal consequence of violation the duty". In the third chapter I have dealed with driving offences. Offence is one of the administrative torts, which is defined by Offence Act no. 200/1990 Coll. It is unlawful action which violates or endangers protected interests of society. Driving offences violate or endanger safety and fluency of the road traffic. Title of this thesis: Proceedings for administrative infractions in the first instance The thesis deals with administrative infraction proceedings in the first instance, specifically about the steps of administrative office before instituting the administrative proceedings. It is based on the new scholarly literature, incorporates new judicature and takes account of methodologies of Ministry of the Interior and practical problems. In the chapter I there are defined administrative infraction proceedings, its relation to Administrative proceedings Act and the infraction and there is also described the possibility of using analogy. In the chapter II there is description of the main procedural principles of administrative infraction proceedings and their importance to proceedings. In addition to the principles resulted directly from Misdemeanours Act there are also described the constitutional and administrative principles. In the chapter III there is described competence of administrative office in administrative infraction proceedings, namely subject-matter jurisdiction, local jurisdiction and function competence. MISDEMEANOUR PROCEDURE (DEVELOPMENT AND CURRENT REGULATION) Misdemeanour procedure is a highly frequent kind of administrative activity which intervenes in legal relations of expressly determined physical entities. The object of this procedure is to decide the issue of guilt and possible penalty for committed deed, in which the misdemeanour is found as a kind of administrative offence. Misdemeanour procedure is envisaged as a part of discharge of public administration bound for rectification of obligors' behaviour and protection of public interest. This institute, being common in administrative practice, affects a considerable number of individuals. In accordance with the legal order, a great amount of administrative bodies is entitled to solve and sanction misdemeanours within the framework of various fields of human activities. Misdemeanour procedure is designed as a specific sort of administrative proceedings built-up on the subsidiarity principle of the Act No. 500/2004 Sb. (Code of Administrative Procedure), which constitutes general rules about administrative proceedings. Protection of personal data

The primary aim of this dissertation thesis is to present a comprehensive analysis of the issue of personal data protection in the Czech Republic with regard to the regulation in the EU. The secondary goal of this work is to explore the historical genesis and material sources of the issue in question. The core information sources from which the thesis draws represent laws, judicial decisions, official documents and Czech/foreign expert literature. In order to achieve the objectives of the work, the methods that are generally applicable in the field of legal science were used. Therefore the method of description (including classification), analysis and synthesis is mostly applied. The dissertation consists of seven chapters. After a short introduction, it begins with a sociological treatise on the importance of the protection of personal data in the 21st century. Privacy is currently an important topic in the light of the rapid development of information and communication technologies which have been developing since the second half of the 20th century and burgeoned since the turn of the century. Technological innovations allow for the collection of personal data on a large scale. These privacy infringements can prove to be irreversible, hence the importance of this area of law.
