Movement and hazardous wastes management from the perspective of international law

89 Summary Movement and hazardous wastes management from the prespective of International law. The purpose of this thesis is to examine the movement and hazardous wastes management or more precisely the international and European law that regulates it. The movement, particularly the transboundary movement, and the management belong to high risky activities considering the protection of human life and the environment. Hand in hand with the management of radioactive waste and chemical substances, they fall under the subject matter of International Environmental Law (IEL). Most of the sources of IEL are not binding "soft law" due to the delicacy of the subject matter on which is hard to get a global consent. In the centre of the attention is the Basel Convention on the Control of Transboundary movements of Hazardous Wastes and their Disposal. Unfortunately it can not be described as a global convention, because the contracting parties are virtually only states of the Euro-American region. On the other side stands the Bamako Convention which was prepared by the Organization of African Unity and which placed the total ban on imports of hazardous wastes to the African continent. Legal aspects of brown coal exploitation limits

The thesis aims to provide an analysis of the legal limits imposed on brown coal exploitation in the Czech Republic, including an assessment of how these limits enter into particular stages of coal mining. The first chapter summarizes the applicable mining law legislation. The second chapter deals with restrictions set out by protection of the environment rules. Furthermore, the following chapter focuses on specific topic of so called ecological limits of exploitation. The fourth chapter points out the limits laid by the right of ownership. Finally, the thesis comprises a summary of contained conclusions.

133 The Real Estate Cadastre The theme of this thesis is the Real Estate Cadastre of the Czech Republic. Land record has almost a thousand-year tradition in our country. A demand of publicity and foreseeability of legal relations to immovables and first of all the tax purposes were the stimuli of its establishment. The aim of this thesis is to characterize the contemporary evidence of immovables, to point out the important social task, which the Real Estate Cadastre fulfils, and to describe its keeping and updating. The thesis consists of six chapters. The introduction focuses on the definition of a land record. It has been used as an universal term for number of evidence instruments that have fulfilled various functions and have adapted for public demand. Chapter 2 dwells on the system development of the evidence instruments concretely. Present form of the Real Estate Cadastre comes out from the connection of two developmental branches of land records - land cadastres and public registers. Most of their existence they functioned separately side-by-side and served for different purposes. Land cadastre was an instrument of tax policy. 80 Summary My thesis is focused on food law in the Czech Republic and abroad. I have chosen this topic, because I think it is very interesting and still current. The main objective this thesis is to present contemporary legal regulations of food law. The significant attention is focused on safely and wholesome of food, data of wraps and consumer awareness of healthy life style. I dealed with these topics in the Czech Republic, in the Europea Union and in Australia. First chapter deals with basics principles of food law in the Czech Republic and in Europea Union. I describe also the most important documents and regulations of food law in this chapter. In two other chapters is described generaly systems of ensurance safely and healthy food in the European Union and in the Czech Republic. Legal regulation of air protection against pollution

in english The aim of this thesis is to provide a systematic insight into the regulation of air protection from pollution produced by so called "enumerated stationary sources", which means from sources enumerated in annex no. 2 of Act no. 201/2012 Coll., focused on the on air protection. The work is divided into two sub-parts when the first part focuses on the proposed legislation in the field of air protection from pollution, its historical development, and legislation at all levels - expressly international law, law of European union and national legislation. Subsequently, the thesis describes the basic objectives of current legislation with regard to all sources of air pollution. The second part of the thesis concerns only on legislation that adjusts enumerated stationary sources and presents a list of various legal instruments of control in a systematic division of conceptual, administrative and economic tools, which is always given to the appropriate section. These particular tools are discussed with regard to the specifics applied to these enumerated stationary sources. The conclusion is a separate chapter devoted to liability for infringement of operators that run the enumerated stationary sources.
Case law of the European Court of Justice in environmental protection focussed on animal and plant protection

57 ZÁVĚR V oblasti ochrany životního prostředí, konkrétně v oblasti ochrany přírody bylo přijato velké množství předpisů a efektivně již dlouho funguje výkon kontroly dodržování pravidel, který zabezpečuje Evropský soudní dvůr. Přesto nelze Soudní dvůr označit za soud, který by byl v zakládacích smlouvách explicitně nadán speciálními pravomocemi na úseku ochrany životního prostředí. Výsledky dlouholeté rozhodovací činnosti posunuly tuto oblast do popředí zájmu, když ji sám Soud označil za jeden z cílů Společenství. Stalo se tak ještě dříve, než byla ochrana životního prostředí zmíněna ve Smlouvě v samostatné kapitole, k čemuž došlo s účinností Jednotného evropského aktu, i předtím, než se do úvodních ustanovení mezi cíle zařadila po bok jiných základních hospodářských, sociálních, kulturních apod. i ochrana životního prostředí, kterou s sebou přinesla Maastrichtská smlouva. Na Soudní dvůr je třeba nahlížet z pozice zaujatého pozorovatele s komplexním zájmem o evropské právo, činnost Soudního dvora, orientovat se v organizační struktuře, znát pravomoci jednotlivých hlavních orgánů i fáze a výsledky legislativní činnosti. Topic of this thesis is "Relation between European Union law and Czech mining law" and its introduction regards mining, concept of mining law and how European Union law works in general. Next chapter regards what relation human rights has to mining. Main focus of this text is overview of most important legislation of European Union law that influence Czech mining law.
