International insolvency law
Čermák, Jan ; Brodec, Jan (advisor) ; Růžička, Květoslav (referee)
This diploma thesis deals with the topic of international insolvency law, in particular with certain areas of European insolvency law, with an emphasis on the matters of international jurisdiction for opening of main and territorial insolvency proceedings and international jurisdiction to hear actions related to insolvency proceedings. Furthermore, this diploma thesis is aimed at evaluation of the Czech legislation regarding cross-border insolvencies. The legal framework for European insolvency law was incorporated into the Insolvency regulation in 2002. Due to disagreements between certain member states of the EU regarding some of the important institutes of cross-border insolvencies the Insolvency regulation often contains vague provisions. It, therefore, fell to the Court of Justice of the European Union to provide interpretation of such ambiguous clauses. In 2012 the European commission created a report on the application of the Insolvency regulation and simultaneously presented a long awaited proposal for modernisation of the European insolvency law in the form of the Insolvency regulation recast. The aim of the Insolvency regulation recast is to promote cooperation between member states in the matter of cross-border insolvency proceedings. Additionally, it codifies a substantial part of the...
Phonological changes between Old and Middle English (an algorithmic approach)
Marek, Daniel ; Tichý, Ondřej (advisor) ; Čermák, Jan (referee)
The purpose of this thesis was to create an automatic analyzer of phonetic changes in the historical development of English, namely between Old and Middle English. The analyzer gets an OE and ME form of a word at the input and produces a suggestion of an explanatory sequence of changes connecting these two forms as the output. As sound changes operate mainly on the spoken language, three main subtasks emerge: to create a grapheme-to-phoneme convertor for Old English, the same (although structurally more complicated) for Middle English and a core algorithm that searches for possible sequences that would explain the development of the word between its OE and ME spoken forms. There is a certain regularity in the diachronic phonetic changes, and therefore these can be translated into a set of rules. A general framework is proposed and implemented that works with these rules in a certain formalized fashion that allows their integration within standard algorithms. The form of the rules is largely adopted from regular expressions, with some alterations and additions, the most important being the possibility of using wildcards that are based on phonetic properties. A database of phoneme representations and phonetic properties is taken from Kirshenbaum's 1992 proposal for ASCII representation of IPA symbols. In the...
The role of the mother tongue in EFL classes
Ménová, Martina ; Gráf, Tomáš (advisor) ; Čermák, Jan (referee)
This thesis focuses on the use of the mother tongue in foreign language teaching and learning. Recently there has been a notable shift towards promoting the use of the mother tongue. The theoretical part of the thesis maps the attitudes to the mother tongue in current literature as well as the suggested ways of its use in the classroom. The practical part attempts to analyse the students' attitudes towards the incorporation of Czech into English learning and teaching and their experience with its use from their secondary schools. To obtain the data, an online questionnaire was employed. The respondents are first- and second-year students of English and American studies who are expected to be able to analyse both the advantages and disadvantages of using Czech. The practical part focuses on the efficiency of Czech in comparison with English, ways of presenting grammar and vocabulary, the relation between the mother tongue use and the proficiency of students, and learning strategies of the respondents. Based on the analysis, suggestions regarding the mother tongue use are presented in the conclusion.
Using Children's Literature in Teaching English at Elementary Schools
Vraštilová, Olga ; Mánek, Bohuslav (advisor) ; Mothejzíková, Jarmila (referee) ; Čermák, Jan (referee)
of the thesis The dissertation thesis deals with the problem of using children's literature in teaching foreign languages at elementary schools. It frames the topic by Czech curricular documents and constituents of the teaching-learning process, provides a historical survey and lists the genres of the children's literature. It characterizes the skill of reading in foreign language teaching and deals with the position of the literary text and lesson planning with children's literature within the foreign language teaching process. Attention is also paid to children's literature as the constituent of the pre-service teacher training. The aim of the thesis is to find out whether children's literature is used in foreign language teaching at elementary schools, whether contemporary textbooks use it, how it is perceived by in-service and pre-service teachers and last but not least what children's literature in the teaching-learning process of foreign languages has to offer. Research tools used for the purposes of the thesis were questionnaires, observations, specially prepared teaching materials based on literary texts and analysis of a textbook. The research proved that children's literature is used both by contemporary textbooks and by teachers in the foreign language education process. Since there is...
Ancrene Wisse, Guide for Anchoresses, A Czech translation.
Petříková, Klára ; Čermák, Jan (advisor) ; Franková, Milada (referee) ; Malura, Jan (referee)
Abstract, Ancrene Wisse, "Guide for Anchoresses" A Czech Translation (2015) Klára Petříková Ancrene Wisse (Guide for Anchoresses) is a remarkable work of the Middle English literature dating back to the first half of the 13th century. Its author (presumably a Dominican) conceived it as "spiritual life guidelines" for three sisters of a noble origin who decided to renounce the world. Besides its didactic purpose, its character is meditative and contemplative. Riveting in its style, its rich metaphors and heightened sensibility link it with the later tradition of the English mystical writers (Julian of Norwich), The work abounds in quotations, paraphrases of the continental monastic authors (St. Augustine, Bernard of Clairvaux). Surviving in seventeen manuscripts, it had been quoted till the Renaissance and its importance is further confirmed by a contemporaneous translation into Latin and French. Present translation aims to introduce this work to the Czech readers and to put it in its historical, social and literary context.
Localisation of Version D of "The Poema Morale" based on "The Linguistic Atlas of Early Middle English"
Vaňková, Marie ; Čermák, Jan (advisor) ; Tichý, Ondřej (referee)
The present MA thesis presents an analysis of version D of the Early Middle English verse sermon known as the Poema Morale. The objectives of the study were to verify the present localisation of D in Western Kent and clarify its relations to two more copies of the same text (T and M). The research consistsed in analysing the language of the text it terms of its dialect and distinguishing between different layers of copying, where possible. The analysis was performed using the electronic tool Linguistic Atlas of Early Middle English, specific procedures included mainly analyses of maps showing the distribution of dialectal features found in D, which were complemented by discussions of forms which D shares with other Kentish texts or versions T and M. The aim of these discussions was the identification of words coming from the exemplar. Evidence supporting the localisation of D in Kent as well as forms presumably taken from the archetype were presented and put in the context of the results of previous studies.
Eventive objects after "have" and "take" - identification and translation correspondences
Křístková, Jana ; Brůhová, Gabriela (advisor) ; Čermák, Jan (referee)
The present MA thesis is concerned with an English verbonominal construction, which consists of a semantically light verb, in the case of the present thesis have and take, with an eventive object. The construction represents one semantic unit, which is proved by a paraphrase in which the object replaces the whole construction as the verb of the clause without any change of meaning. The construction affects the aspectual features of the verb, which is reflected in Czech translation equivalents. It also allows for easier modification and quantification. The kind of determiner and modifier present has an impact on the Czech counterparts, most importantly on the aspect of the verb. Modifiers usually translate as adverbials or adjectives modifying a syntactic object, if the Czech counterpart is verbonominal. The integration of the English modifiers into the Czech sentence is often problematic. The thesis presents a theoretical survey of information on the topic and provides a linguistic description of 279 examples of the construction obtained through the online corpora InterCorp. The examples are analyzed with respect to determiners, quantifiers and modifiers. This, along with the Czech counterparts, is the basis for conclusions on the influence of the construction on the translation to Czech.
Analogy in word-formation: the evidence of OED
Seidlová, Klára ; Čermák, Jan (advisor) ; Müllerová, Světlana (referee)
The present thesis aims to provide a detailed characterization of analogy as a word-formation process in the context of the historical development of English. The research part of this paper analyses a selection of words modelled on the analogy of already existing ones, as implied in the Etymology section of The Oxford English Dictionary. The extracted data is examined from the perspectives of the distinct historical periods of the English language in terms of the word-formation processes as well as the word classes affected by these changes. Corpus based analysis of selected idiomatic phrases and their development in time
Menhartová, Kateřina ; Tichý, Ondřej (advisor) ; Čermák, Jan (referee)
The present thesis examines the historical development of selected idiomatic phrases, namely, keep one's word, speak one's mind, lend a hand, bury the hatchet, rock the boat, and toe the line. The study is based on data from the English Historical Book Collection, Parsed Corpus of Early English Correspondence, Corpus of Historical American English, and Hansard Corpus. The research focuses on the idioms' first occurrence in the corpora, development of construction, frequency, and possible passivization and internal modification instances. Additionally, the results on the expressions' syntactic flexibility are compared to the existing hypotheses of linguists, and its possible reasons and rules are investigated. It was found that some of the idioms had various forms, which alternated for a time before the norm was established. Some appear in different constructions in the 20th century still. Further, the syntactic flexibility seems to be greater than stated in the cited theoretical works. It is concluded that the idiom's ability to passivize or be internally modified might depend on its type, which is connected to its meaning and the meaning of its constituents, pragmatics, and even their age and established place in language, as some idioms show a growing flexibility. Key words: diachronic corpus...
