Probation in system of criminal sanctions from the point of view of prevention of recidivm

The theme of my diploma thesis is the efficiency of the probation supervision of the system of justice. My aim is to inform wheather and in which way the probation supervision helps to reduce the risk of crime's relapse. This diploma thesis is divided into two parts. The first one is theoretical whereas the second one is practical. In the theoretical paragraph I explain the aims and reasons of probation supervision. The wide scope of taking advantages of this care is also mentioned. I describe all activities connected with the above. The pecularities of youngters's probation supervision are pointe dout, as well. Last but not least I inform about the course of the probation supervision and try to compare alternative sanctions to the imprisonment. A statistic survey of probation supervision in last few years makes a part of my thesis, too. The second part of my thesis is based on my practice in the centre of probation and mediation care. I mention the results of my research among the members of the working team in the above organisation and social worker's for youngsters and adults. Juvenile probation programmes application in practice in Sweden compared with potentialities of application in the Czech Republic

Tato diplomová práce se zaměřuje na sociální práci v trestní justici z praktického pohledu, která je spojena s teoretickým rámcem filozofie restorativní justice1. Hlavním smyslem alternativního způsobu řešení trestních věcí je přiměřená reakce na spáchané provinění mladistvého a odstranění konfliktního stavu spojeného s tímto proviněním, a to s ohledem na okolnosti a objasnění příčin konfliktního stavu. Alternativní odklony v trestním řízení a v sankcích jsou výrazem individuálního přístupu k provinilcům. Zákon č. 218/2003 Sb., o soudnictví ve věcech mládeže k takovému pojetí diferenciace a individualizace ve smyslu restorativní justice výrazně napomohl. Celorepublikově se stále nedaří efektivně aplikovat institut probačního programu ve všech soudních okresech České republiky2. Podle mého názoru, zmíněný zákon příliš spěchal s účinností, aniž by byla důkladně zmapována oblast možností samotného státního sektoru (např.personální kapacity orgánů činných v trestním řízení, zejména pak středisek PMS ČR3) a kapacit a kompetencí NGO4 sektoru. Podle obsahu uvedeného zákona se totiž předpokládá perfektní kompatibilita nestátního sektoru se státní sférou na úseku výkonu opatření pro mladistvé provinilce! Samotná PMS ČR totiž nemůže probační programy v ČR sama vytvářet, na rozdíl od švédského pojetí.

"Záludné město" as an Approach in Working with Youth at Risk

"Záludné město" (Tricky City) is an interactive board game focused on prevention of risk behaviour. Originally it is aimed at primary school professionals. These theses are trying to find possibilities of using it as a social work approach in working with youth at risk. Modification of the game is based on theoretical issues and it is suggested as a method for opening a space for discuss a risk behaviour and as an assesment tool for client's knowledge and attitudes about risk behaviour. It is tested on a target group of youth drop-in centres.

Comparsion of Working Processes and Evaluation of Differences before and after the Implementation of the System of Timely Intervention at the Department of Social Prevention and Social-Legal Protection of Children of the Prague 2 Municipality.

This work concentrates on the newly implemented System of timely intervention in the Prague 2 district. I am emphasizing here mainly the system of work of the department of social prevention and social-legal protection of children, with the aim to compare the work processes and evaluation of differences of working with the vulnerable and endangered youth before and after the implementation of the System of early intervention in the Prague 2 district. The theoretic part concentrates on the description of the starting situation and an introduction of the existing system of work of the department of social prevention and social-legal protection of children and the to-date used organizationally-administrative working processes with the vulnerable and endangered youth within this department. Given the specifics of work in this area I am also aiming to explain the basic terms - the vulnerable and endangered youth, delinquent behavior, and prevention of social-pathological phenomena. In order to provide a full picture, I have also summarized the overview of organizations and preventive activities available in the given area of Prague 2 district. Mediator's competences - with externalization on the education of mediators

Bachelor work "Mediator's competences - with externalization on the education of mediators" focuses on description of mediator's profession and specializes in educational system. In the first part of this work I descripe what mediation is and who mediator is. In the part called Professional competences is described mediator's personality, his/her tasks and the flow of his/her activities as well. It also deals with skills that are essential for his/her work and problematic situations that could appear in his/her work. In the end of this part there are several proposals how to improve his/her work. In further part the work focuses on formal compenteces that are jointed with the legal framework. I descripe present legal framework in the Czech republic, international legal context and I also mention the bill about mediation in the civil area. In the next part you can find information about the educational system in several countries of European Union and about the educational system in the Czech republic. In the final part there is a small survey. Its main aim was to find out what should improve in the education of mediators.

Activities of Probation and Mediation Service of CR focused on working with victims

Téma své diplomové práce jsem zvolila s ohledem na aktuálnost problematiky, kterou se zabývá. Práce vychází z faktu, že poškozený má v rámci trestního řízení stále nerovné postavení, ačkoliv je jednou ze stran trestního řízení. Státním subjektem, který se na tuto situaci snaží reagovat a "usiluje o zprostředkování účinného a společensky prospěšného řešení konfliktů spojených s trestnou činností" s ohledem na zájmy a potřeby obou stran trestního konfliktu, včetně společnosti je Probační a mediační služba České republiky (PMS). (Výroční zpráva, 2006, s. 5) Dle mých zkušeností, které jsem získala na odborných stážích na střediscích PMS, však spolupráce pracovníků Probační a mediační služby s oběťmi trestných činů (oběťmi) nedosahuje žádoucí intenzity a frekvence. Aktuálnost potřeby zlepšení podpory obětí dokazuje i fakt, že zmiňované téma je již čtvrtým rokem jednou z priorit PMS. Proto dané téma považuji za důležité a aktuální. Diplomová práce má dvě části - teoretickou a výzkumnou. Hlavním cílem diplomové práce je zmapovat aktuální stav odborné praxe pracovníků Probační a mediační služby vyvíjené ve vztahu k obětem trestných činů v rámci základních odborných agend. Účelem práce není vyčerpávajícím způsobem popsat činnost PMS ve vztahu k obětem trestných činů, ale jejím záměrem je poskytnout alespoň rámcovou...

Association of penitentiary and postpenitentiary services: reasons for constitution and suggestion of its activities

Oblast trestní justice a výkonu trestu je tradičně doménou státu. V nestátní neziskové sféře nicméně působí množství organizací, které taktéž orientují své aktivity n a obviněné, odsouzené nebo propuštěné lidi nebo jejich blízké. Počet poskytovatelů služeb pro tuto cílovou skupinu ještě narost v souvislosti s nešvarem existujícím v jejich fundraisingové praxi přizpůsobovat pod vlivem finanční nejistoty zaměření své činnosti aktuálně vypisovaným výzvám dotačních program ů (zde m ám n a mysli zejména dotace z ESF). Podmínky ve sféře pomoci lidem v konfliktu se zákonem 1 komplikuje také to, že přesahuje do dvou resortů - M inisterstva spravedlnosti a M inisterstva práce a sociálních věcí. V reakci na tuto poněkud nepřehlednou a pro jednotlivé subjekty kom unikačně náročnou situaci byla v listopadu 2006 z iniciativy několika NNO založena Asociace poskytovatelů penitenciárních a postpenitenciárních služeb (dále APPPS), o.s. Měla jsem příležitost být jejím u vzniku přítom na a přispět k něm u. Tato m á dosud trvající zaangažovanost mě podnítila k zájmu hlouběji pochopit spletité poměry panující v současné penitenciární a postpenitenciární oblasti. Úvahy o budoucnosti APPPS, n a jejímž utváření se jakožto členka výkonného výboru asociace spolupodílím, mě inspirovaly k napsání této práce.

Organization structure and activity of Probacy and Mediacy of Czech Republic in Prague with focus on activity of section Parole

In my bachelor work I'm engaged in questions regarding the probacy service and especially in subject of parole. In the work the are discussed particular parts of the service, however the main emphasis is placed on parole. The important part is also about historical roots, thanks to which we were able to reach the todays levels. And of course the need to move forward, educate and improve current systems. For the practital part of my work I have put together casuistries, which I met during my practice in Prague probacy centre. For each casuistry I'm trying to show its specifity and I'm thing over how they were figured out by the court and how the resulst have influented the clients future life. In my work I'm lininig out the part of the social worker in this sector and his role to improve the whole system. It is importnant to point out the connection with law, that means that working for probacy service is asking high profession demands. It is necessary to be well acquainted with the legal system and be professional in comunication with the client. However the most important role is to make the clients life easier in their hard times and help them to better and upstanding life.
