[cze][eng] V této bakalářské práci jsou popsány postupy dědického řízení podle aktuálně platných legislativních úprav, které se vztahují k tomuto tématu, jejichž principy jsou obsažené především v Občanském zákoníku a v Občanském soudním řádu. Práce dále podrobně definuje specifika autorských práv v řízení o dědictví.
Dalším cílem práce je popsat a objasnit specifika dědění majetkových práv autorských, vysvětlit a zpřehlednit zásady nakládání s majetkovými právy, a to zejména v průběhu neskončeného řízení o dědictví autora. V tomto kontextu si autor dále klade za cíl zmapovat a utřídit postupy, které jsou spojeny se získáváním oprávnění k užití autorského díla v období, kdy není nositel majetkových práv pravomocně potvrzen.This Bachelor?s Honours Thesis describes the inheritance proceedings in
accordance with the current legal regulations related to the topic the
principles of which are stipulated especially by the Civil Code and Judicial
Code. The work also defines in detail particularities of the copyright within
the inheritance proceedings.
This thesis also sets itself the task to describe and explain particularities
of inheriting the intellectual property as well as to make clear the
principles of dealing with property rights especially during a non-complete
inheritance proceeding. Within this context the author aims to research
and sort out the procedures connected with gaining the rights to use an
author?s work in the period when the property rights? owner shall not be
legitimately sustained.
