Výklad ústavních zvyklostí v kabinetních manuálech a judikatuře soudů vybraných států westminsterského systému Tato diplomová práce předkládá výzkum vlivu ústavních zvyklostí ve vybraných státech westminsterského systému a soustředí se zejména na narůstající tendence využívání kabinetních manuálů jako nástrojů pro oficializaci zvyklostí. Přestože tyto manuály míří k větší právní jistotě a transparentnosti ústavní praxe, nelze opomenout obavy ohledně jejich vlivu na snižování flexibility zvyklostí, která byla vždy jejich klíčovým znakem. Kanada, Austrálie, Spojené Království a Nový Zéland poskytují rozmanitý rámec pro komparaci mezi westminsterskými státy s kodifikovanou i nekodifikovanou ústavou. Tento rámec umožňuje práci blíže zkoumat nuance mezi psanými a nepsanými ústavními pravidly. Diplomová práce se zaměřuje na výzkum způsobů, jakými kabinetní manuály a soudní rozhodnutí interpretují ústavní zvyklosti ve vybraných státech westminsterského systému. Snaží se zvláště o zodpovězení otázky, zda tyto výklady zvyšují právní jistotu spočívající v jasnosti ústavních pravidel, či spíše jen oslabují flexibilitu ústavních zvyklostí. While these manuals aim to enhance clarity and transparency, they also raise concerns about potentially undermining the flexibility that has historically been a defining characteristic of conventions. The thesis examines this tension by comparing four Westminster systems: Canada, Australia, the United Kingdom, and New Zealand. These countries offer a rich comparative framework, allowing for analysis of both codified and uncodified constitutions, revealing nuanced perspectives on the interplay between written and unwritten constitutional norms. Furthermore, the thesis analyzes the ways in which Cabinet Manuals and court decisions articulate and interpret constitutional conventions in Canada, Australia, the United Kingdom, and New Zealand. It seeks to understand whether these interpretations enhance clarity or risk undermining the inherent flexibility of these unwritten rules.
