[cze][eng] Kybernetická kriminalita a její vyšetřování Tato práce pojednává o kybernetické kriminalitě, jejím specifikům a vyšetřování. Primárním zaměřením práce je popsat co je vlastně kybernetická kriminalita, jak vznikla, jak se projevuje, jak se proti ní bránit a jakým způsobem se vyšetřuje. Součástí práce je analýza současného stavu legislativy jak z pohledu hmotněprávního, kdy se práce věnuje podobě trestných činů, které se na případy kybernetické kriminality aplikují, tak z hlediska procesněprávního, kdy je zaměřena na některé instituty sloužící k vyšetřování této kriminality. V závěru práce obsahuje zamyšlení autora nad současným stavem legislativy v oblasti kybernetické kriminality, poukazuje na její slabší místa a navrhuje případné změny. První kapitola se věnuje definování pojmu kyberprostoru, kybernetické kriminality, popisu historického vývoje až po současné trendy a budoucí směřování a zmiňuje přijatá preventivní opatření. Druhá kapitola se následně věnuje některým specifikům kybernetické kriminality a jejím podobám v praxi, které jsou v rámci kapitoly podřazeny pod jednotlivé skutkové podstaty. Ve třetí kapitole práce pojednává o vyšetřování kybernetické kriminality, se zaměřením zejména na popis a specifika digitálních stop, jejich zajištění, analýzu a přeshraniční spolupráci. The primary focus of this thesis is to describe what cybercrime actually is, how it emerged, how it manifests, how to defend against it, and how it is investigated. Additionally, the thesis analyzes the current state of legislation from both a substantive law perspective, addressing the forms of criminal offenses applicable to cybercrime cases, and a procedural law perspective, focusing on certain legal instruments used in cybercrime investigations. The first chapter is dedicated to defining the concept of cyberspace and cybercrime, describing its historical development up to current trends and future directions, and mentioning preventive measures that have been implemented. The second chapter then examines specific aspects of cybercrime and its practical manifestations, which are categorized under different legal definitions of criminal offenses. The third chapter discusses the investigation of cybercrime, with a particular focus on the description and specifics of digital traces, their collection and analysis, and cross-border cooperation.
