Důvody výpovědi z nájmu bytu Abstrakt Rigorózní práce se podrobně věnuje důvodům, pro které lze vypovědět nájem, a to jak stran nájemce tak pronajímatele. Práce je členěna do šesti kapitol, z čehož první kapitola je věnována historickým a obecným pojednáním o nájmu, zejména je však kladen důraz na východiska úpravy nájmu bytu, tj. ochrana slabší smluvní strany a ochrana vlastnického práva. Rovněž je věnován prostor základním charakteristikám nájmu bytu. Druhá kapitola se zaobírá výkladem o výpovědi z nájmu dle obecných ustanovení o nájmu, zejména pak prvkem dočasnosti a jeho vlivem na možnost nájem vypovědět. Třetí kapitola popisuje již výpověď z nájmu bytu a vztah obecné úprav k zvláštní úpravě nájmu bytu. Samotné výpovědní důvody jsou podrobně analyzovány v kapitole čtvrté a páté. Výpovědním důvodům na straně nájemce je věnována právě kapitola čtvrtá, která se postupně věnuje možnosti vypovědět nájem na dobu určitou či naopak neurčitou a následně zákonným výpovědním důvodům. Ty jsou konkrétně rozebrány v podkapitolách o výpovědi pro změnu okolností a o výpovědi bez výpovědní doby. Pojednáno je i o otázce trvání výpovědního důvodu k okamžiku doručení výpovědi. Pátá kapitola pokračuje s rozborem konkrétních výpovědních důvodů, tentokrát však na straně pronajímatele. První podkapitola popisuje důvody... i Reasons for notice of termination of the residential lease Abstract The thesis deals in detail with the reasons for which the lease can be terminated, both by the tenant and the landlord. The work is divided into six chapters, of which the first chapter is devoted to historical and general treatises on the lease, but especially emphasis is placed on the basis of the residential lease, ie protection of the weaker party and protection of property rights. Space is also devoted to the basic characteristics of residential lease. The second chapter deals with the termination of the lease according to the general provisions on the lease, especially the element of temporality and its impact on the possibility of terminating the lease. The third chapter describes the termination of the residential lease and the relationship of the general regulation to the special regulation of the residential lease. The reasons themselves are analysed in detail in Chapters Four and Fifth. The fourth chapter is devoted to the reasons for termination on the part of the tenant, which gradually deals with the possibility of terminating the lease for a definite or indefinite period, and subsequently to the legal reasons for termination.
