Bakalářská práce Zapomenout, nebo odpustit? Proces vyrovnávání se s odkazem Francisca Franka ve španělské společnosti skrze zákony o paměti popisuje vliv historie na současnou situaci ve Španělsku. V práci dochází k rozboru definice vyrovnávání se (reconciliation), popsání kontextu demokratické tranzice a traumat vyplývajících ze španělské občanské války a čtyřiceti let diktatury. Prostřednictvím rozboru Zákonu o historické paměti 2007 a Zákonu o demokratické paměti 2022 autorka mapuje změny v přístupu Španělska k tranzitní spravedlnosti a vyrovnávání se s odkazem Francisca Franka. Další část se věnuje polarizaci společnosti v zemi a nárůstu extrémní pravice a hledá její propojenost s minulostí. Závěrem práce je zodpovězení výzkumné otázky, tedy zda zákony o paměti vedou k vyrovnanému Španělsku. Ačkoliv oba zákony splnily několik bodů implementace tranzitní spravedlnosti a přispěly k procesu vyrovnávání se, reakce na tuto legislativu byly poměrně kritické a španělská společnost zůstává ve věci frankistické minulosti značně polarizovaná. Závěrem práce tedy autorka poukazuje na nedokončenost procesu implementace tranzitní spravedlnosti a absence ukončení beztrestnosti, což figuruje jako hlavní překážka procesu vyrovnávání se. Demokratická tranzice se snažila o zapomnění a odpuštění, nicméně nové... Bachelor thesis To forget or to forgive? The process of reconciliation with the legacy of Francisco Franco in Spain through memory laws describes the influence that history has on the current situation in Spain. The thesis analyses the definitions of reconciliation and describes the context of the Spanish democratic transition and the traumas resulting from the Spanish Civil War and forty years of dictatorship. Through an analysis of the Historical Memory Law 2007 and the Democratic Memory Law 2022, the author charts the changes in Spain's approach to transitional justice and reconciliation with the legacy of Francisco Franco. The next part examines the polarization in Spanish society and the rise of the extreme right, looking for its connection to the past. The thesis concludes by answering the research question, of whether memory laws lead to reconciliation in Spain. Although both memory laws have fulfilled several aspects of the implementation of transitional justice and contributed to the process of reconciliation, the reactions to these legislations have been quite critical, and Spanish society remains polarized on the issue of the Francoist past.
