Náhradní výživné v České republice Tématem diplomové práce je náhradní výživné, které bylo do českého právního řádu zavedeno přijetím zákona č. 588/2020 Sb., o náhradním výživném pro nezaopatřené dítě a o změně některých souvisejících zákonů (zákon o náhradním výživném). Cílem diplomové práce je jednak analyzovat tuto právní úpravu, poskytnout kritický pohled na určité její části a současně zasadit náhradní výživné do širšího kontextu situace neúplných rodin a forem pomoci, které jim stát poskytuje. První kapitola je věnována samotným neúplným rodinám a jejich vzniku, kdy je zvláštní pozornost zaměřena na genderové aspekty samoživitelství. V této souvislosti se diplomová práce zabývá také problematickou situací samoživitelů související s jejich uplatněním na trhu práce a současně zvýšeným rizikem ohrožení chudobou a sociálního vyloučení. V druhé kapitole se autorka zabývá soukromoprávní úpravou vyživovací povinnosti a práva na výživné, a to s důrazem na vyživovací povinnost vůči zletilým a nezletilým dětem, z níž fakticky zákon o náhradním výživném vychází. Jeho prostřednictvím totiž dochází k propojení institutů soukromého a veřejného práva, když stát poskytuje náhradní výživné v situaci, kdy povinné osoby, nejčastěji rodiče, tuto svou povinnost neplní. Substitute Maintenance in the Czech Republic The thesis focuses on substitute maintenance, introduced into the Czech legal system by Act No. 588/2020 Coll., on Advance of Maintenance Payment for Dependent Child and on Amendments to Certain Related Acts (Act on Advance of Maintenance Payment). The thesis aims to analyse this legislation, provide a critical perspective on selected sections, and place substitute maintenance in the broader context of single-parent families and the aid measures provided to them by the state. The first chapter examines the phenomenon of single-parent families and their origins, with particular focus on the gendered aspects of single parenthood. It also addresses the employment opportunities for single parents, their challenging situation in the labour market, and the increased risk of poverty and social exclusion they face in the long term. The second chapter deals with the private law regulation of the maintenance obligation and the right to maintenance, emphasizing the maintenance obligation towards adult and minor children, which the law on substitute maintenance stems from.
