ROZHODOVACÍ PRAXE APELAČNÍHO SOUDU A CONSTITUTIO CRIMINALIS JOSEPHINA (1687-1727) Disertační práce JUDr. Josef Vacek Klíčová slova: apelační soud; právní dějiny; 17. století; trestní právo; rozhodovací praxe; prameny práva; raný novověk Abstrakt Předkládaná práce se zabývá proměnou rozhodovací praxe pražského apelačního soudu v trestních věcech a to v souvislosti s vydáním nového trestního zákoníku Constitutio Criminalis Josephina z roku 1707. V práci je nejprve analyzován dosavadní stav bádání, na který navazuje rozbor vnitřního uspořádání soudu, včetně mechanismů výběrů a přijímání nových radů. Významný prostor je věnován též relevantním právním předpisům pro činnost apelačního soudu a celkově pro trestní právo v období od konce 16. století od vydání Koldínova zákoníku do počátku 18. století, kdy byla Josephina vydána. Těžištěm práce je rozbor tisíců rozhodnutí vydaných apelačním soudem v trestních věcech, a to ve třech oblastech: delikty proti životu, majetková trestná činnost a sexuální delikty. Základním pramenem se staly ortelové manuály, knihy vedené u apelačního soudu, od kterých byla zaznamenávána rozhodnutí především v trestních věcech - jedná se o tisíce záznamů v češtiny, němčině a místy též latině. V každé z uvedených oblastí práva byly vybrány dva, resp. tři delikty, u nichž byla provedena... ROZHODOVACÍ PRAXE APELAČNÍHO SOUDU A CONSTITUTIO CRIMINALIS JOSEPHINA (1687-1727) Disertační práce JUDr. Josef Vacek Keywords: court of appeal; legal history; 17th century; criminal law; decision-making practice; sources of law; early modern period Abstract This thesis deals with the change in the decision-making practice of the Prague Court of Appeal in criminal cases in connection with the new criminal code Constitutio Criminalis Josephina of 1707. The thesis first analyses the current state of research, followed by an analysis of the internal structure of the court, including the mechanisms of selection and recruitment of new councillors. Significant space is also devoted to the relevant legislation for the work of the Court of Appeal and for criminal law in general in the period from the late 16th century, when the Koldin's Municipal Code was published, to the early 18th century, when Josephina was published. The focus of the work is an analysis of the thousands of decisions handed down by the Court of Appeal in criminal cases, in three areas: offences against life, property crime and sexual offences.
