Vymezení státního území ČR a změny státních hranic Abstrakt Práce je zaměřena na rozbor státního území a státních hranic České republiky. Zejména se zaměřuje na historický vývoj a platné právní předpisy, které utvářejí státní hranice současné České republiky. Nejdříve se zaměřuji na pravé jádro hraničního práva. Vzhledem k tomu, že státní území vychází z Ústavy České republiky, provádím rozbor ústavních ustanovení a navazujících zákonů, které tvoří právní základ hraničního práva, jeho ochranu a další klíčové aspekty. Dále analyzuji ústavně-historický vývoj České republiky od okamžiku rozpadu Rakouska-Uherska po první světové válce, který představuje znovuzrození hranic samostatného a suverénního českého státu (případně Československa). V rámci historické kapitoly jsou rozebírány změny a jiné události týkající se státních hranic před a po druhé světové válce, období socialismu, vzniku federace až po vznik samostatné České republiky. Jelikož jsou právní normy a mezinárodní smlouvy, týkající se státních hranic, velice specifické a náročné, věnuji jednu kapitolu přímo procesu přenesení mezinárodní smlouvy do reálného světa. Jedná se o popis pracovní náplně tzv. hraničních komisí, jejíchž práce na poli státních hranic je zcela zásadní. V neposlední řadě se věnuji detailnímu rozboru všech platných právních norem... Delimitation of the state territory of the Czech Republic and changes to state borders Abstract The diploma thesis focuses on the analysis of the state territory and state borders of the Czech Republic. In particular, it focuses on the historical development and current legislation that shapes the state borders of the present Czech Republic. Initially, I focus on the true core of border law. Given that the state territory is based on the Constitution of the Czech Republic, I analyse the constitutional provisions and related laws that form the legal basis of border law, its protection and other key aspects. Further, I analyse the constitutional and historical development of the Czech Republic since the dissolution of Austria-Hungary after the First World War, which represents the rebirth of the borders of an independent and sovereign Czech state (or Czechoslovakia). The historical chapter discusses the changes and other events concerning the state borders before and after the Second World War, the period of socialism, the emergence of the federation and the establishment of the independent Czech Republic.
