Nelegální zaměstnávání a jeho postih Abstrakt Tématem této rigorózní práce je nelegální zaměstnávání a jeho postih. Práce se zaměřuje na analýzu situací, kdy dochází k umožnění nelegálního zaměstnávání a k samotnému výkonu nelegální práce a dále se věnuje komplexnímu pohledu na postih nelegálního zaměstnávání a nelegální práce. Cílem práce je poskytnout komplexní analýzu různých druhů nelegální práce, jako je nelegální zaměstnávání cizinců, bezesmluvní práce a švarcsystém. Práce se dále zaměřuje na identifikaci příčin a důsledků tohoto jevu a analýzu možností, jak tomuto negativnímu fenoménu čelit. Pozornost je rovněž věnována sankcím, které jsou spojeny s nelegálním zaměstnáváním a nelegální prací. Rigorózní práce je strukturována do devíti věcných kapitol, přičemž tematicky je možné ji rozdělit do čtyř hlavních oblastí. První část se věnuje závislé práci, zkoumá její charakteristiku, znaky a podmínky, za kterých je vykonávána. Druhá část pojednává o nelegální práci samotné, přičemž je zde vysvětlen pojem nelegální práce a jeho vývoj v rámci právního řádu České republiky. Dále se tato část zabývá druhy nelegální práce, mezi které se řadí nelegální zaměstnávání cizinců, bezesmluvní práce a švarcsystém. Klade se zde důraz na analýzu jejich právních aspektů a rovněž se zabývá příčinami. Třetí část je věnována... Illegal employment and its sanction Abstract The topic of this rigorous thesis is illegal employment and its sanction. The thesis focuses on the analysis of situations when illegal employment and the actual performance of illegal work is enabled and furthermore it takes a comprehensive view on the sanctions against illegal employment and illegal work. The aim of the thesis is to provide a comprehensive analysis of different types of illegal work, such as illegal employment of foreigners, non-contractual work and false self-employment. The thesis also aims to identify the causes and consequences of this issue and to analyze the possibilities to counteract this negative phenomenon. Attention is also paid to the sanctions that are associated with illegal employment and illegal work. The thesis is structured into nine substantive chapters and can be divided thematically into four main parts. The first part deals with dependent work, examining its characteristics, features and the conditions under which it is performed. The second part deals with illegal work itself, explaining the concept of illegal work and its development within the legal system of the Czech Republic.
