Vydržení, se zvláštním důrazem na mimořádné vydržení Abstrakt Tématem diplomové práce je tradiční soukromoprávní institut vydržení. Přestože vydržení neztratilo význam ani po rekodifikaci soukromého práva (ba naopak získalo v mnoha ohledech nový význam), recentní zdroje mu nevěnují náležitou pozornost a mnoho tajů vydržení zůstává nepoznaných, což se tato diplomová práce snaží napravit. Práce je tudíž koncipována jako celistvé pojednání o vydržení, dotýkající se nejrůznějších aspektů tohoto institutu a přinášející nové postřehy ohledně této problematiky. Práce zkrátka nemá být jen souhrnem notoriet. V práci je konkrétně rozebrán dějinný vývoj vydržení, jež přináší některé nadčasové závěry. Nechybí ani rozbor předpokladů vydržení dle současného občanského zákoníku: v jednotlivých pasážích je tak rozebrána držba a kvalita, které musí dosahovat, aby vedla k vydržení, jakož i práva, jež lze vydržet, dále subjekty vydržení a vydržecí doba. Práce přitom není založena jen na povšechném popisu, ale vychází z kritické analýzy současné judikatury soudů všech stupňů a doktríny, jakož i z hledání odpovědí na dosud neobjasněné, problematické otázky. Práce se snaží proniknout do materie vydržení hlouběji a nad rámec recentních tuzemských zdrojů, a proto věnuje pozornost například otázce, jaký je vztah norem upravujících... Acquisitive prescription, with special emphasis on extraordinary acquisitive prescription Abstract The topic of the thesis is the traditional private law institution of acquisitive prescription. Although acquisitive prescription has not lost its significance even after the recodification of private law (on the contrary, it has acquired a new meaning in many respects), recent sources do not pay due attention to it and many secrets of acquisitive prescription remain unknown, which this thesis seeks to remedy. The thesis is therefore conceived as a comprehensive treatise on acquisitive prescription, touching upon various aspects of this institution and bringing new insights into the subject. In short, the work is not intended to be a mere compendium of notorieties. The work specifically discusses the historical development of acquisitive prescription, which provides some timeless conclusions. There is also an analysis of the prerequisites for acquisitive prescription under the current Czech Civil Code: the individual passages discuss possession and the quality it must achieve to lead to acquisitive prescription, as well as the rights that can be acquired by prescription, the subjects of acquisitive prescription and the acquisitive prescription period.
