Účast obhájce v přípravném řízení Abstrakt Právo na obhajobu řadíme k nejdůležitějším základním právům osoby, proti níž se trestní řízení vede. Lze ho definovat jako soubor práv, které zákon dává osobě, aby se mohla účinně bránit proti vznesenému obvinění a aby mohla chránit svá práva a zájmy v trestním řízení. Osoba, proti níž se trestní řízení vede, musí být v každém stádiu řízení srozumitelně poučena o svých právech a musí jí být umožněno jejich plné uplatnění. Právo na obhajobu se skládá z několika složek. Jeho nedílnou součástí je právo hájit se v procesu sám a prostředky dle vlastního rozhodnutí, právo zvolit si obhájce a radit se s ním o způsobu obhajoby a právo vyžadovat od orgánů činných v trestním řízení takový postup, aby byl zjištěn skutkový stav věci bez důvodných pochybností a v rozsahu nezbytném pro rozhodnutí. Tato diplomová práce je rozvržena na úvod, tři části a závěr. První část práce se zabývá právní úpravou práva na obhajobu a obsahem zásady zajištění práva na obhajobu. Druhá část práce se věnuje postavení obhájce v přípravném řízení. Obhájcem v trestním řízení může být podle § 35 odst. 1 trestního řádu pouze advokát. Předpokládá se, že si obviněný obhájce sám zvolí. Pokud si obviněný obhájce nezvolí, ačkoli ho podle zákona mít musí, bude mu obhájce na dobu, po kterou trvají důvody... Participation of the defense attorney in the preliminary proceeding Abstract The right of defense is one of the most important fundamental rights of a person against whom criminal proceedings are conducted. It can be defined as a set of rights which the law gives to a person in order to enable him or her to defend himself or herself effectively against the charges brought against him or her and to protect his or her rights and interests in criminal proceedings. The person against whom criminal proceedings are brought must be clearly informed of his or her rights at every stage of the proceedings and must be able to exercise them fully. The right of defense consists of several components. It includes the right to defend oneself in the proceedings by the means of one's own choice, the right to choose a defense attorney and to consult him on the manner of defence, and the right to require the criminal proceedings authorities to proceed in such a way as to establish the facts of the case beyond reasonable doubt and to the extent necessary for a decision. This diploma thesis is divided into an introduction, three parts and a conclusion.
