1 Abstrakt Předkládaná diplomová práce se zabývá trestní odpovědností při nakládání s omamnými a psychotropními látkami ve zdravotnictví, která je doprovázena množstvím zákoutí, které se v práci snažím rozkrýt. Práce zkoumá povinnosti a odpovědnost poskytovatelů zdravotních služeb, jejichž role je klíčová pro zajištění kvalitní péče a bezpečí pacientů. Práce se v první části zaměřuje na definování základních termínů z oblasti poskytování zdravotních služeb. Dále práce analyzuje povinnosti, které musí poskytovatelé zdravotních služeb, tedy zejména lékaři, dodržovat. Stěžejním termínem je povinnost lege artis, přičemž v práci jsou detailněji rozebírány jednotlivé aspekty této povinnosti, její porušení v podobě postupu non lege artis, a následně jsou uvedeny i příklady z praxe. Druhá část práce se věnuje léčivým přípravkům, přičemž je nejprve uveden jejich vývoj až po registraci, a následně jejich předepisování. Důležitým tématem je také medikace off-label, která "získala popularitu" zejména v období pandemie COVID-19. Stěžejním tématem jsou poté léčivé přípravky obsahující omamnou a psychotropní látku, včetně prekurzorů, a následně užití "drog", tj, konopí a psychedelik, při léčbě různých onemocnění. Třetí část práce se zabývá trestní odpovědností a jejími základními aspekty, společně s okolnostmi... The present thesis deals with the criminal liability in the handling of narcotic drugs and psychotropic substances in the health care sector, which is accompanied by a number of nooks and crannies that I try to reveal in the thesis. The thesis explores the duties and responsibilities of health service providers, whose role is crucial to ensuring quality care and patient safety. The first part of the thesis focuses on defining basic terms in the field of health service delivery. Then the thesis analyses the obligations that health service providers, especially doctors, have to comply with. The key term is the duty of lege artis, and the thesis discusses in detail the various aspects of this duty, its violation in the form of non lege artis procedure, and then provides examples from practice. The second part of the thesis is devoted to medicinal products, whereby their development up to registration is first presented, followed by their prescription. An important topic is also off-label medication, which "gained popularity" especially in the period of the COVID-19 pandemic. The third part of the thesis deals with criminal liability and its basic aspects, together with circumstances precluding illegality, which are focused on the area of provision of health services.
