Náhrada nemajetkové újmy při ublížení na zdraví a usmrcení v adhezním ří- zení Abstrakt Tato diplomová práce se zabývá náhradou nemajetkové újmy při ublížení na zdraví a us- mrcení v kontextu trestního řízení. Práce je členěna do pěti kapitol, přičemž první kapitola se vě- nuje pojmu poškozeného, jeho definici, úloze v trestním řízení, právům a povinnostem a hodnotí jeho potřeby a cíle v rámci trestního řízení. Druhá kapitola se zabývá institutem adhezního řízení, jeho definicí, popisem průběhu a analýzou pozitivních a negativních aspektů právní úpravy adhez- ního řízení. Třetí kapitola se zaměřuje na problematiku nemajetkové újmy při ublížení na zdraví, vývoj právní úpravy a způsoby výpočtů jednotlivých nároků. V další kapitole je rozebrána náhrada újmy při usmrcení, pojmové vymezení jednotlivých nároků, okruh odškodňovaných osob a návrh na jeho rozšíření. Pátá kapitola se zaměřuje na vybrané problémy související s náhradou nemajet- kové újmy při ublížení na zdraví a usmrcení ve světle trestního řízení. Navzdory určitým změnám ve prospěch poškozených stále existují nedostatky jak v právní úpravě, tak v praxi. Tato diplomová práce poukazuje na potřebu aktualizace Metodiky, která by zohledňovala duševní bolest, a přidání konkrétních položek a bodového ohodnocení pro vyjádření této bolesti. Compensation for non-material damage in the event of injury and death in col- lateral proceedings Abstract This thesis explores compensation for non-material damage in the event of injury and death within the context of criminal proceedings. The thesis is divided into five chapters. The first chap- ter focuses on the concept of the injured party, its definition, its role in criminal proceedings, rights, and obligations. Additionally, it delves into the assessment of the injured party's needs and goals in the context of criminal proceedings. The second chapter deals with the institution of collateral proceedings, providing a definition and describing its course. The third chapter focuses on the issue of non-material damage in the event of injury, the calculation of compensation, the court's procedure in the calculation, and the development of case law. The next chapter discusses the compensation for injury in case of death, the conceptual definition of individual claims, the range of persons compensated, and the proposal to expand it. The fifth chapter focuses on selected prob- lems related to compensation for non-material damage in personal injury and death within the framework of criminal proceedings.
