91 Abstrakt: Sociální ochrana rodin při úmrtí dítěte před porodem a po něm Diplomová práce rozebírá problematiku sociální ochrany rodin, které se potýkají se ztrátou potomka. Pod tuto sociální událost spadají děti mrtvě narozené, děti, které zemřely bezprostředně či krátce po porodu, plody po potratu a po umělém ukončení těhotenství. Práce je dělena do tří hlavních částí. První kapitola zasazuje celou problematiku do kontextu současné doby. Je zde rozebírána terminologie, které se na téma úzce váže, a to včetně jejího vývoje v čase. Tato část se současně zmiňuje i o směrech, kterými se ubírala zahraniční právní úprava a v neposlední řadě je zde na základě dříve rozebraného pojmosloví vymezena zkoumaná sociální událost, tím je i vymezen okruh analyzovaných případů. Část druhá jakožto jádro textu obsahuje podrobný rozbor použitelných institutů, které se mohou v rámci práva sociálního zabezpečení v definovaných případech uplatnit. S inspirací u samotného sociálního systému České republiky je i tato kapitola dělena podle prvního a druhého pilíře na dávky sociálního pojištění a dále pak dávky státní sociální podpory. Vzhledem k provázanosti institutů je zmíněna i pracovněprávní ochrana a její rozsah. Pro získání uceleného přehledu o možné podpoře kapitola obsahuje současně i péči poskytovanou ze sociálních... 92 Abstract: Social protection of families experiencing the death of their child before and after birth The thesis analyses the issue of social protection of families who are facing the loss of their infant. This includes stillborn children, children who died immediately or shortly after birth, fetuses after miscarriage and after artificial termination of pregnancy. The thesis is divided into three main parts. The first chapter places the whole issue in the context of the present time. It discusses the terminology closely related to the topic, including its development over time. At the same time, this part also mentions the directions taken by foreign legislation and, last but not least, the scope of the cases analysed is defined. The second part, the core of the text, contains a detailed analysis of the applicable institutes that can be applied in the framework of social security law in the defined cases. Taking inspiration from the social system of the Czech Republic itself, this chapter is also divided according to the first and second pillar: into social insurance benefits and state social support benefits.
