Rozpočtové určení daní územním samosprávným celkům Abstrakt Tato diplomová práce pojednává o tématu rozpočtového určení daní územním samosprávným celkům. Rozpočtové určení daní je rozsáhlá a stále aktuální problematika, která má zásadní vliv na fungování státu a územních samosprávných celků a současně s tím pomáhá vykreslit jejich vzájemné vztahy. Daňové příjmy jsou stěžejními příjmy veřejných rozpočtů, kterými se zajišťuje financování základních funkcí státu, veřejných statků, služeb a chod veřejné správy. Rozpočtové určení daní je vzhledem k množství subjektů s rozdílnými zájmy na jeho podobě součástí politického souboje a má značný dopad i na životy běžných obyvatel, přestože s ním není široká veřejnost blíže obeznámena. Cílem této práce bylo z pohledu práva popsat, obecně analyzovat a zhodnotit rozpočtové určení územním samosprávným celkům. Autorem byla vybrána obecná kritéria pro zhodnocení a analýzu systému rozpočtového určení daní a jeho právní úpravy - jednoduchost, přehlednost, celistvost či administrativní náročnost. Tato práce je tak obecným teoretickým základem a východiskem pro možné budoucí podrobnější zkoumání rozpočtového určení daní. V práci je definován pojem rozpočtového určení daní, zároveň je zařazen v systému práva a autor se jím zabývá v souvislosti s konstrukčními prvky daně. Práce... Budgetary allocation of taxes for municipalities and regions Abstract This thesis deals with the topic of budgetary allocation of taxes for municipalities and regions. Budgetary allocation of taxes is a comprehensive and ongoing issue that has a significant impact on the functioning of the state, regions and municipalities while also helping to define their mutual relationships. Tax revenues are essential income for public budgets, providing funding for the basic functions of the state, public goods, services and the operation of public administration. Due to the number of entities with different interests in its form, the budgetary allocation of taxes is part of a political battle and has a significant impact on the lives of ordinary citizens even though the general public is not familiar with it in detail. The aim of this thesis was to describe, analyse, and evaluate budgetary allocation of taxes to municipalities and regions from a legal perspective. The author selected general criteria for evaluating and analyzing the system of budgetary tax allocation and its legal regulation such as simplicity, clarity, integrity, and administrative complexity.
