Právnické profese a jejich úloha v oblasti boje proti legalizaci výnosů z trestné činnosti Předkládaná rigorózní práce se zabývá stále aktuální problematikou boje proti legalizaci výnosů z trestné činnosti, pro kterou využívá vhodnější pojem boj proti praní špinavých peněz (AML), přičemž se zaměřuje na úlohu právnických profesí, kterou reprezentují advokáti a notáři. Jedná se o kontroverzní téma, jelikož advokáti a notáři mohou působit v různých úlohách. Na jedné straně mají při provádění sledovaných činností status povinné osoby, která uplatňuje AML opatření ve vztahu ke svým klientům a jejich obchodům za účelem zabránění zneužívání finančního systému k praní špinavých peněz, a na straně druhé plní roli zprostředkovatele v procesu praní špinavých peněz, což deklarují tuzemské i zahraniční případy. Cílem práce je tyto odlišné role právnických profesí představit a zjistit, zda má česká právní úprava v oblasti AML nějaké výrazné nedostatky. V této souvislosti je také úkolem zhodnotit fungování systému AML v České republice se zaměřením na právnické profese v postavení povinných osob a jejich nejzranitelnější služby. K dosažení vytyčených cílů jsou v práci využity metody deskripce, analýzy, syntézy a komparace. Práce přibližuje proces praní špinavých peněz, instituce, které se podílejí na boji proti... Legal professions and their role in combating money laundering The submitted thesis deals with the topic of combating the legitimisation of proceeds of crime for which the term 'anti-money laundering' (AML) is appropriate, while focusing on the role of legal professions represented by lawyers and notaries. This is a controversial topic because lawyers and notaries can act in different roles. On the one hand, when performing monitored activities, they have the status of an obligated person who applies AML measures in relation to their clients and their businesses in order to prevent the abuse of the financial system for money laundering. On the other hand, they fulfil the role of "gatekeepers" to money laundering efforts, due to the varied nature of services they provide. The aim of the thesis is to present these different roles of legal professions and to find out whether the Czech legislation in the area of AML has any significant shortcomings. In this context, it is also a task to evaluate the functioning of the AML system in the Czech Republic with a focus on legal professions and their most vulnerable services.
