Výhrada soupisu v pozůstalostním řízení - vybrané otázky Abstrakt Tato diplomová práce se věnuje vybraným otázkám výhrady soupisu pozůstalosti v dědickém řízení - konkrétně omezení odpovědnosti dědice za dluhy zůstavitele v historických souvislostech i v současné době dle aktuálně platného institutu výhrady soupisu pozůstalosti. Diplomová práce řeší ve své úvodní části historický vývoj institutu výhrady soupisu, a to od římského dědického práva, přes středověký vývoj, Patent č. 946 Sb. z. s. císaře Františka I (zákoník ABGB), postihuje změny ve dvacátém století - tedy zejména politické vlivy komunistického režimu v dědickém právu zákona č. 141/1950 Sb. a dále komparaci s občanským zákoníkem z roku 1964. Ze současnosti jsou uvedeny novinky a výhody, které přináší nařízení Evropského parlamentu a Rady (EU) č. 650/2012 pro přeshraniční dědická řízení. Dále pak je zde porovnání s rakouským dědickým právem, zejména oblastí odpovědnosti za dluhy zůstavitele a jejich vypořádání v ležící pozůstalosti a po nabytí právní moci o odevzdání dědictví. Ve druhé kapitole, věnované právní teorii občanského zákoníku č. 89/2012 Sb., je popsán pojem i účel výhrady soupisu pozůstalosti. Uplatnění výhrady soupisu pozůstalosti pak v příkladech rozšiřuje právní teorii o výsledky provedeného empirického výzkumu, ze kterého plyne... Reservation as to estate inventory in inheritance law - key topics Abstract This thesis addresses selected issues of the reservation as to estate inventory in probate proceedings, specifically the limitation of the heir's liability for the decedent's debts. The issue was addressed in historical contexts and under the currently valid institute of the reservation as to estate inventory. The introduction of the thesis deals with the historical development of the institute of the reservation as to estate inventory, then pursues the issue from Roman inheritance law, through medieval development, Patent No. 946 Civil Code of Emperor Franz I (ABGB), and covers changes in the 20th century, namely the political influences of the communist regime in inheritance law of Act No. 141/1950 Sb., as well as a comparison with the Civil Code of 1964. The thesis includes the current news and benefits brought by Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession.
