181 Určování mateřství Abstrakt Tématem této diplomové práce je určování mateřství. Jejím cílem je zmapovat situace, které určování mateřství znesnadňují nebo znemožňují a zhodnotit jejich právní úpravu či na- vrhnout její doplnění. Práce je členěna do osmi kapitol, přičemž první kapitola je věnována definici pojmu mateřství a jeho historii, aktuální právní úpravě a vzniku. Druhá kapitola je zaměřena na asistovanou reprodukci. Popisuje její základní principy, historický vývoj, platnou právní úpravu a možná rizika. S asistovanou reprodukcí souvisí i ka- pitola třetí týkající se surogátního mateřství. V této kapitole je upozorňováno na nedostatečnost právní úpravy dané oblasti a po zhodnocení možných následků její absence je zpracován návrh základu právní úpravy de lege ferenda. Zmíněna je na tomto místě také vysoce kontroverzní možnost tzv. celotělního dárcovství. Čtvrtá kapitola popisuje ve stručnosti právní úpravu osvojení, jakožto jedné z možností, jak může mít dítě v souladu se zákonem v rodném listě zapsanou jako matku ženu odlišnou od té, která ho porodila. Naráží zde také na možnost osvojení dítěte osobou v registrovaném part- nerství a její umožnění zrušením části zákona o registrovaném partnerství Ústavním soudem. V páté kapitole jsou shrnuty situace, které mohou způsobit, že matka dítěte není... 182 Determination of motherhood Abstract The topic of this thesis is the determination of motherhood. Its aim is to identify the situ- ations that make the determination of motherhood difficult or impossible and to evaluate their legal regulation or to propose its supplementation. The thesis is divided into eight chapters, with the first chapter being devoted to the definition of the term motherhood and its history, current legislation and origins. The second chapter focuses on assisted reproduction. It describes its basic principles, his- torical development, current legislation and possible risks. Chapter three, focusing on surro- gacy, is also related to assisted reproduction. This chapter draws attention to the lack of legal regulation in this area and, after an assessment of the possible consequences of its absence, a de lege ferenda draft of the basis for legal regulation is drawn up. The highly controversial option of whole-body donation is also mentioned here. The fourth chapter briefly describes the legal regulation of adoption, as one of the possi- bilities of how a child can legally have a woman different from the one who gave birth to him or her on the birth certificate.
