Ochrana a obrana povinného v rámci exekučního řízení v souvislosti s velkou novelou exekučního řádu Abstrakt Tato diplomová práce se zabývá zásadou ochrany a obrany povinného, která je stěžejní zásadou exekučního práva, a která se odráží v mnoha jeho významných institutech. O této zásadě je pojednáváno v souvislosti s novelou exekučního řádu, která byla provedena zákonem č. 286/2021 Sb., a je nejčastěji nazývána novelou "velkou". Tato novela se mimo jiné výrazně dotkla právě tradičních institutů exekučního práva, které jsou odrazem zásady ochrany a obrany povinného v právním řádu. Cílem této práce je zhodnocení velké novely exekučního řádu a dále analýza zásady ochrany a obrany povinného, která je důležitá pro pochopení celého obsahu práce. Těžiště diplomové práce pak tvoří komplexní pojednání o institutech ochrany a obrany povinného, kterých se velká novela exekučního řádu dotkla nejvýrazněji, a zhodnocení těchto provedených změn a novinek. Pro lepší orientaci je text rozdělen do čtyř částí, které jsou dále členěny na jednotlivé kapitoly a podkapitoly. První část se zabývá exekučním řádem, včetně okolností jeho vzniku a jeho vztahem k občanskému soudnímu řádu. Na tomto místě je také provedena analýza velké novely exekučního řádu, včetně jejího zhodnocení. Druhá část pojednává o zásadách exekučního řízení,... Protection and defence of the debtor in distraint proceedings in connection with the major amendment to the Distraint Procedure Code Abstract This Master's thesis deals with the principle of protection and defence of the debtor, which is the core principle of the distraint law and which is reflected in many of its important institutes. This principle is referred to in connection with the amendment to the Distraint Procedure Code, which was implemented by Act No. 286/2021 Coll. and is most often referred to as the "major" amendment. Among other things, this amendment significantly affected the traditional institutes of the distraint law, which reflect the principle of protection and defence of the debtor in the legal system. The aim of this thesis is to evaluate the major amendment to the Distraint Procedure Code and to analyse the principle of protection and defence of the debtor, which is important in order to understand the complete content of the thesis. The paper is focused on a comprehensive examination of the institutes of protection and defence of the debtor, which were most significantly affected by the major amendment to the Distraint Procedure Code, and an evaluation of these changes and updates.
