Srovnávací analýza právního postavení účastníků individuálních pracovněprávních vztahů v právních řádech Anglie a Walesu a České republiky Mgr. Barbora Cowell Abstrakt Tato disertační práce se zabývá porovnáním právního postavení subjektů základních pracovněprávních vztahů v právních řádech Anglie a Walesu a České republiky. Klade si za cíl zodpovědět výzkumnou otázku, v jakých ohledech by se český právní řád mohl inspirovat anglickou právní úpravou. První část této práce shrnuje recentní vývoj v Anglii a Walesu ovlivňující stávající, jakož i budoucí podobu právní úpravy postavení subjektů základních pracovněprávních vztahů. Druhá část analyzuje základní třídění fyzických osob vykonávajících práci podle obou právních řádů. Třetí část rozebírá základní povinnosti subjektů základních pracovněprávních vztahů v obou právních řádech. Čtvrtá část se věnuje rozboru autorkou vybraných práv, jež pracovníkovi (tj. jak zaměstnanci, tak pracovníkovi v užším slova smyslu) přiznává anglické pracovní právo/právo sociálního zabezpečení, a následně porovnává tato práva pracovníka s korespondující právní úpravou českou. Pátá část se soustředí na rozbor autorkou vybraných práv, jež zaměstnanci přiznává anglické pracovní právo, a na následné srovnání těchto práv zaměstnance s odpovídající právní úpravou českou. Barbora Cowell Abstract In this dissertation, the author performs the comparative analysis of the laws of England and Wales and the laws of the Czech Republic governing different types of employment status and rights/obligations associated with each type. The author aims to answer the following research question: In what ways could the Czech legal system draw inspiration from the laws of England and Wales governing different types of employment status and rights/obligations associated with each type? The first part of the dissertation summarises recent developments in England and Wales impacting the current as well as future legal rules in this area. The second part deals with the basic categorisation of different types of employment status in both legal systems. The third part analyses the fundamental duties of employees/workers and employers in both legal systems. The fourth part focuses on a selection of rights granted to workers by English employment law and English social security law and compares them to the corresponding rights set out by Czech employment legislation.
