v českém jazyce, název práce a klíčová slova Specifika výslechu dětí Děti, tedy osoby mladší osmnácti let, jsou skupinou osob, která se v trestním řízení objevuje nikoli ojediněle, a to v různém procesním postavení. Mohou se tak dostat do situace, kdy bude potřeba je vyslechnout. Oproti dospělým děti potřebují jiný přístup a zasluhují zvláštní ochranu. Toho si všímá i právní úprava, která na více místech upravuje speciální zacházení s dětmi během trestního řízení včetně zacházení s dětmi během výslechu. Mezi tato ustanovení patří ustanovení o nutné obhajobě mladistvého, o přítomnosti některých dalších osob u výslechu nebo ustanovení upravující možnost vést výslech před zahájením trestního stíhání. K možnostem výslechu před zahájením trestního stíhání a následnému čtení takto získaných protokolů o výslechu se z hlediska zachování práv obhajoby vyjádřil Ústavní soud i Evropský soud pro lidská práva. Oba zmíněné soudy došly k závěru, že takto získaný důkaz lze použít v trestním řízení i navzdory porušení práva na spravedlivý proces, protože jsou v takovém případě dány jiné záruky zákonnosti nebo je důvodem pro toto omezení ochrana jiných základních lidských práv. Judikatura nicméně vymezila i hranice používání takto získaných důkazů, jelikož dovodila, že je nelze použít jako důkaz stěžejní. Z... in English, Title and Keywords The Specifics of Children Interrogation Children, meaning people under 18 years of age, appear in criminal procedures rather often and have various process statuses. Therefore, they can get into a situation in which they have to be interrogated. In these cases, they need a different approach than adults. Moreover, they also deserve an extra level of protection. Legislation has taken this into account by specifying how children should be treated during criminal procedures, interrogation included, in numerous details. Amongst these legal provisions, one can find for example the legal provision about necessary protection of minors, about the presence of certain other people during interrogation or the provision regulating the possibility of interrogating children before the prosecution officially begins. Both the Constitutional Court of the Czech Republic and also the European Court of Human Rights have commented on the possibilities of interrogating children before the prosecution start and then using such obtained protocols, especially on the aspect of preserving the rights of defense.
