Postavení Ústavního soudu v systému dělby moci Abstrakt Práce se zabývá definováním postavení Ústavního soudu v systému dělby moci České republiky. Pro porozumění role Ústavního soudu je důležité pochopení historických souvislostí, proto se v první části práce věnuje vývoji a pojmům konstitucionalismu a ústavního soudnictví. V této části se práce zaměří na důležité myslitele, kteří ovlivnili způsob myšlení o moderním státě a rozdělení mocí. Posléze i ústavnímu soudnictví koncentrovanému a difúznímu. V kapitole druhé se věnuje práce vývoji Ústavního soudnictví v Čechách, a to postupně v několika obdobích od Habsburské monarchie, přes období v Československu v letech 1918-1938, 1945-1989 až po vznik Ústavního soudu České republiky v roce 1991, o čemž je pojednáno v závěru tohoto oddílu. V kapitole třetí se práce zaměří na Ústavní soud České republiky, jeho vznik a zákonnou úpravu, charakteristiku soudu jako instituce, funkci soudce Ústavního soudu, specifika a jednotlivé druhy řízení před Ústavním soudem a způsob a závaznost rozhodování Ústavního soudu. V kapitole čtvrté se práce zaměřuje ze začátku obecně na popis dělby moci, jakož i odraz dělby moci v právu České republiky. Poté je popsána role Ústavního soudu v rámci tohoto systému, je vymezen jeho vztah k ostatním komponentům dělby moci a na vybraných... The position of the Constitutional Court in the system of separation of powers Abstract The thesis deals with defining the position of the Constitutional Court in the system of separation of powers in the Czech Republic. In order to understand the role of the Constitutional Court, it is important to understand the historical context, therefore the first part of the thesis deals with the development and concepts of constitutionalism and constitutional justice. In this part, the thesis will focus on important thinkers who have influenced the way of thinking about the modern state and the separation of powers. Subsequently, constitutional justice is concentrated and diffused. The second chapter deals with the development of the Constitutional Judiciary in Bohemia, from the Habsburg Monarchy, through the period in Czechoslovakia in 1918-1938, then the period from 1945-1989 and finally the Constitutional Court which was established in 1991. The third chapter will focus on the Constitutional Court of the Czech Republic, its establishment and legal regulation, the characteristics of the court as an institution, the function of a judge of the Constitutional Court, the specifics and individual types of proceedings before the Constitutional Court and the manner and binding nature of the Constitutional Court's...
