Trestněprávní aspekty korupce Tato diplomová práce se zaměřuje na korupci jako na negativní společenský fenomén, pohledu trestního práva jako prostředku Analyzuje hmotněprávní a procesněprávní aspekty korupce ve smyslu české, ale se zejména úplatkářskými trestnými činy a nástroji prostředky používanými při odhalování, vyšetřování a dokazování korupčního jednání. Úvodní část textu této diplomové práce se soustředí na vysvětlení pojmu korupce a pojmů přímo či nepřímo subsumovaných pod termín korupce, a mimo jiné i příčinami vzniku, vývojovými stádii a členěním korupce včetně způsobů korupčního jednání. Dále ve kapitole této práce je na korupci pohlíženo z do dějin tohoto jevu celosvětovém měřítku, se zaměřením zejména na první zmínky o korupci a právní úpravy účinnými na území českého státu od roku 1707 do sametové revoluce. Hlavní část diplomové práce je obsažena v třetí a čtvrté kapitole. Třetí kapitola se zaměřuje na trestných činů úplatkářských trestných činů výkladem trestněprávních ustanovení upravujících jejich trestní ů se čtvrtá kapitola soustředí na proces vyšetřování těchto trestných činů orgány činnými v trestními řízení korupčních deliktů. přidává zejména nejdůležitějších mezinárodních organizací a jejích protikorupčních nástrojů souvisejících s členství České republiky Evropské unii je značná... Criminal Aspects of Corruption This diploma thesis focuses on corruption as a negative social phenomenon which is as old as humanity itself, especially, through the viewpoint of criminal law as a means for ultima ratio. It analyses substantive and processional law aspects of corruption in legal regulations of the Czech Republic as well as in international regulations. This thesis concerns itself with criminal acts of bribery and means used to uncover, investigate, and prove corruptive practices. The introduction of this thesis concentrates on the explanation of its key term "corruption" and terms that directly or indirectly fall under the concept of corruption, as well as the reasons why corruption occurs, its development stages and the structure of corruption, including manners of corruptive behaviour. In the second chapter of this thesis the author looks at corruption from a historical viewpoint by means of an excursion into the global history of this phenomenon. Especially concentrating on the first references to corruption and legal regulations in place on the Czech territory since 1707 up to the Velvet Revolution.
