67 Náhrada při újmě na přirozených právech člověka (§ 2956-2968 OZ) Abstrakt Tato diplomová práce přibližuje koncepci institutu náhrady nemajetkové újmy na přirozených právech člověka v zákoně č. 89/2012 Sb., občanský zákoník. Hlavním cílem této práce je podat základní, ucelený pohled na problematiku náhrady újmy na přirozených právech člověka a prezentovat názory a myšlenky členů právní obce i mé vlastní na některé z hojně diskutovaných dílčích témat. V práci jsou dále rozebrány nejdůležitější změny, kterými se současná úprava liší od úpravy obsažené v zákoně č. 40/1964 Sb., občanský zákoník. V práci je pracováno s komentářovou literaturou, odbornými publikace a recentní i starší judikaturou českých soudů. V první kapitole je rozebrána úprava přirozených práv, a to nejprve krátce na ústavní úrovni, což je důležité pro pochopení pevného zakotvení přirozených práv v právním řádu. Navázáno je úpravou na občanskoprávní úrovni, která je obsažená v části první občanského zákoníku. Dále se diplomová práce věnuje institutu odpovědnosti za způsobenou újmu, prevence vzniku újmy a základním předpokladům, které jsou pro vznik újmy zapotřebí. Instituty se spojí v kapitole třetí, kde je pojednáno o obecné koncepci náhrady za újmu na přirozených právech člověka. Nejdůležitější a nejrozsáhlejší část práce se věnuje... 68 Compensation for injury to the natural rights of man (Section 2956-2968 of the Civil Code) Abstract This diploma thesis introduces the concept of the institute of compensation for immaterial harm to the natural rights of man in Act No. 89/2012 Coll., Civil Code. The main aim of this thesis is to provide a basic, comprehensive insight into the issue of compensation for harm to the natural rights of man and to present the opinions and thoughts of members of the legal community and my own on some of the widely discussed subtopics. The thesis also analyses the most important changes that distinguish the current regulation from the regulation contained in Act No. 40/1964 Coll., Civil Code. The thesis is based on commentary literature, relevant publications and recent as well as older case law of the Czech courts. The first chapter focuses on the regulation of natural rights, first briefly at the constitutional level, which is important for understanding the solid foundation of natural rights in the legal system. This is followed by the regulation at the civil law level, which is contained in first part of the Civil Code.
