Řízení o pozůstalosti se zaměřením na přechod dluhů zůstavitele Abstrakt Tato diplomová práce s názvem Řízení o pozůstalosti se zaměřením na přechod dluhů zůstavitele se zabývá řízením o pozůstalosti jako takovým s důrazem na přechod dluhů zůstavitele na jeho právní nástupce a jejich vypořádání. Práce je rozdělena do čtyř samostatných kapitol. První kapitola obsahuje obecné seznámení se základními principy a zásadami civilního práva procesního, nesporných řízení a dědictví, s účelem řízení o pozůstalosti a s prameny práva, ze kterých se při pozůstalostním řízení vychází. Další podkapitoly jsou věnovány také vymezení pravomoci a příslušnosti soudu a identifikaci osob zúčastněných na řízení. Druhá kapitola se zabývá průběhem řízením o pozůstalosti se zaměřením na přechod dluhů zůstavitele od jeho zahájení po jeho pravomocné skončení. V kapitole je rozebráno mimo jiné předběžné šetření, zjišťování aktiv a pasiv pozůstalosti, samostatné podkapitoly jsou věnovány výhradě soupisu pozůstalosti a konvokaci věřitelů. Dále je pojednáno o samotném projednání pozůstalosti a rozhodnutí o pozůstalosti. Poslední podkapitola se krátce zabývá dodatečným projednáním pozůstalosti. Třetí kapitola pojednává samostatně o likvidaci pozůstalosti, jelikož se od řízení o pozůstalosti v mnoha ohledech zásadně liší a lze ji považovat... Inheritance proceedings with a focus on the transfer of the testator's debts Abstract This diploma thesis, entitled Inheritance proceedings with a focus on the transfer of the testator's debts, deals with inheritance proceedings as such with an emphasis on the transfer of the testator's debts to his legal successors and their settlement. The thesis is divided into four separate chapters. The first chapter contains a general introduction to the basic principles of civil procedural law, uncontested proceedings, and inheritance, to the purpose of inheritance proceedings, and to the sources of law on which the inheritance proceedings are based. Other subchapters are also devoted to defining the jurisdiction of the court and identifying the persons involved in the proceedings. The second chapter deals with the course of inheritance proceedings with a focus on the transfer of the testator's debts from its commencement to its final termination. The chapter discusses, among other things, the preliminary investigation, identification of the estate's assets and liabilities, separate subchapters are devoted to the reservation of the inventory and convocation of creditors.
