Změna pohlaví z pohledu sociálního práva Abstrakt Tato práce se zabývá právní úpravou změny pohlaví v České republice, konkrétně podmínkami umožnění změny pohlaví, kterými jsou chirurgické zákroky a sterilizace. Českou právní úpravu porovnávám s názory Evropského soudu pro lidská práva a zjišťuji, jestli je v souladu s vývojem v ostatních evropských zemích. Podrobněji se zaměřuji na otázku uzavření manželství a nutnosti ukončení manželství, a v rámci sociálního pojištění úhradou zdravotních nákladů a důchodovým věkem osob, které změnily pohlaví. Touto prací bych chtěla rozšířit povědomí o změně pohlaví, které ve společnosti není příliš rozšířené. Také bych chtěla porovnat českou právní úpravu s pohledem ESLP a zjistit, jestli není příliš zastaralá. Česká právní úprava požaduje pro změnu pohlaví podstoupení chirurgických zákroků a sterilizace, což je v rozporu s judikaturou ESLP a praxí států Evropy. V Radě Evropy umožňuje změnu pohlaví bez sterilizace 31 z 39 států. V judikatuře a společnosti v posledních dvaceti letech nastal posun, který Česká republiky ve své právní úpravě nereflektovala. Tato práce se na vývoj judikatury ESLP zaměřuje, chci ukázat její posun od stanovení povinnosti státu uznat změnu pohlaví až po přiklonění se k úřední změně pohlaví bez nutnosti podstoupit chirurgické zákroky. Gender Reassignment from the Point of View of Social Law Abstract This thesis deals with legislation regulating gender reassignment in the Czech Republic, specifically conditions which allow a person to undergo gender reassignment, like chirurgical procedures and sterilization. I compared Czech legislation with opinions expressed by the European Court of Human Rights. I determined whether Czech legislation is consistent with development in other European countries. I focused in more detail on the topic of people who undergone gender reassignment getting married and being forced to end their current marriage. I also concentrated on payment of medical bills and retirement age within social insurance. I would like to spread awareness of gender reassignment with this thesis, which is not very widespread in society. I would also like to compare Czech legislation with ECHR's opinion and find out whether Czech legislation is too obsolete. Czech legislation demands chirurgical procedures and sterilization for allowance of gender reassignment, which is in contrast with ECHR's case law and other European states' legislations. 31 of 39 states of The Council of Europe permit transgender people gender reassignment without previous chirurgical procedures or sterilization.
