Tato rigorózní práce se zabývá velmi diskutovaným institutem trestního řízení, totiž ohledem na její trvání, průběh. Osobní svoboda patří k nejvýznamnějším právům člověka, do kterého je však na rozdíl od ostatních nejvýše postavených práv (např. práva na život, zákazu mučení atd.) zasahováno v našich podmínkách nejčastěji. Vazba pak po trestu odnětí svobody představuje nejzávaznější z těchto zásahů, a to navíc ještě v době, kdy plné míře zásada presumpce množství podmínek, které musí být splněny, aby osoba mohla být vzata do vazby a následně mohlo být rozhodnuto o jejím dalším trvání. Celou situaci dále komplikuje, že tyto podmínky nejsou obsaženy jen v trestním řádu, ale také Evropské úmluvě o ochraně lidských práv a základních svobod a zejména v judikatuře všechny tyto podmínky přehledně na jednom místě, a to s důrazem na rozhodování o dalším Vazba je stabilně diskutována jak v rámci odborné veřejnosti zejména v přípravou nového trestního řádu, tak v různých mediálních případů. Podrobněji se tato ěnuje například vazbě D. Ratha, S. A. Zadeha, P. Šrytra, ale také mnoha dalším. Zaměřuje se pak zejména na tzv. doktrínu zesílených důvodů a problematiku vazby matek nezletilých dětí. Cílem této práce bylo na základě analýzy konkrétních případů ověřit, zda jsou všechny stanovené a judikaturou dovozené podmínky... The continuation of pre-trial detention Abstract The rigorous thesis deals with the much-discussed institute of the criminal proceeding, namely the pre-trial detention, especially with regard to its continuation, course. The personal freedom is one of the most important and most often infringed human rights in our environment, unlike other highest important rights (e.g. the right to life, the prohibition of torture, etc.). The pre-trial detention is following the imprisonment the most serious of these interventions, even when there is no final conviction and the principle of the presumption of innocence fully applied. The main issue of the pre-trial detention is a number of conditions that must be met so the person could be taken into the detention and subsequent decision on its further continuation could be made. The whole situation is further complicated by the fact that these conditions are not only contained in the Criminal Procedure Code, but also in the European Convention on Human Rights and Fundamental Freedoms and especially in the case law of the Constitutional Court and the European Court of Human Rights.
