Ochrana a obrana povinného v exekuci a soudním výkonu rozhodnutí Abstrakt Tato diplomová práce se zaměřuje na ochranu a obranu povinného v exekuci a v soudním výkonu rozhodnutí. Klade si za cíl komplexně pojednat o uvedené problematice a upozornit na její nedostatky a diskutabilní oblasti při současném zohlednění odlišností exekuce a soudního výkonu rozhodnutí v rovině ochrany i obrany povinného. Práce je rozdělena do tří tematických částí, přičemž každá z nich se dále člení na jednotlivé kapitoly a podkapitoly. První část se zabývá historickými a obecnými východisky pro ochranu a obranu povinného. Moderní dějiny jsou nejen důležité pro sledování vývoje jednotlivých právních ustanovení napříč historickými událostmi, představují ale také zdroj pro lepší pochopení současné právní úpravy. Obecná východiska v podobě ústavněprávních základů a procesních zásad poté reprezentují terminologické jádro všech následujících částí práce. Druhá část pojednává o některých obecných nástrojích ochrany povinného. Stěžejní oblastí této části jsou však projevy ochrany povinného v rámci provádění exekuce a soudního výkonu rozhodnutí. V zájmu přehlednosti jsou projevy ochrany povinného zpracovány ve dvou kapitolách. První z nich se zabývá projevy ochrany povinného při vymáhání peněžitého plnění, druhá pak při vymáhání plnění... Protection and defence of the debtor in execution and in judicial enforcement of judgement Abstract This master's thesis focuses on the protection and defence of the debtor in execution and in judicial enforcement of judgement. It aims to provide a comprehensive discussion of the above mentioned issue and to highlight its shortcomings and debatable areas, while taking into account the differences between execution and judicial enforcement in terms of protection and defence of the debtor. The work is divided into three thematic parts, each of which is further divided into individual chapters and subchapters. The first part deals with the historical and general background of the protection and defence of the debtor. Modern history is not only important for tracing the development of particular legal provisions across historical events, but it is also a resource for a better understanding of contemporary law. General starting points in the form of constitutional foundations and procedural principles provide the terminological core of all subsequent parts of the thesis. The second part deals with some general instruments of protection of the debtor. The core area of this part, however, is the manifestations of the protection of the debtor in the context of execution and judicial enforcement. For the sake of...
