Převod vlastnického práva k nemovitosti a aplikační praxe Abstrakt Cílem mé rigorózní práce je důkladné zanalyzování ustanovení týkajících se převodu vlastnického práva k nemovitosti spolu s uvedením praktických příkladů a s poukázáním na rozmanitou judikaturu a další rozhodnutí, která byla nejen soudní soustavou vytvořena. Zároveň jsem se kromě ustanovení Občanského zákoníku věnovala i ustanovením jiných právních předpisů, především Katastrálnímu zákonu, který je pro převod vlastnického práva klíčový a bez kterého by nemohlo být dosaženo tíženého cíle. Kromě dalších vnitrostátních předpisů jsem poukázala také na důležitost vlastnického práva v mezinárodním kontextu a věnovala se konkrétním krokům převodu i na jiném území nežli jen v rámci České republiky. I přes odlišnost právních předpisů cizích zemí byl však postup velmi podobný, a to v návaznosti na naše členství v rámci Evropské unie, které nám zaručuje stejná práva jako občanům daných zemí. Vlastní text je rozdělen do pěti částí, kdy první z nich se zaměřuje na právní úpravu věci a její pojmové znaky. Zároveň jsem důkladně definovala věc nemovitou, jelikož jde o jeden ze základních stavebních kamenů této rigorózní práce. Druhá kapitola se věnuje vlastnickému právu a spoluvlastnictví. Přesněji jsem definovala práva, ale taktéž povinnosti, které z něj... Application of the Property Right to Real Estates Transfer Abstract The aim of this thesis is to analyze the provisions relating to the transfer of ownership of real estate, together with practical examples referring to the diverse case law and other decisions that were created not only by the judicial system. Apart from the provisions of the Civil Code, I also focused on the provisions of other legal regulations, especially on the provisions of the Cadastr Act, which is a crucial regulation for the transfer of ownership. In addition to other national regulations, I also pointed out the importance of regulation of property rights in international legal context and focused on the foreign legal regulation of specific steps in the transfer of real estate. Despite the differences in the legal regulations of foreign countries, the legal regulation of the procedure for the transfer of real estate was very similar, following our membership within the European Union, which guarantees us the same rights as the citizens of those countries. The thesis is divided into five parts, the first of which focuses on the legal regulation of thing and its conceptual features.
