Mikroplasty a plasty z právního pohledu Abstrakt: Disertační práce se věnuje nakládání s mikroplasty z pohledu práva, a to v návaznosti na stále rostoucí znečištění životního prostředí plasty. Jedná se o problematiku, která dosud na této úrovni v českém prostředí zpracována nebyla. V rámci disertační práce je řešeno nejen nakládání s primárními mikroplasty, které je existující právní úpravou na úrovni jednotlivých států řešeno nejčastěji, ale také nakládání se sekundárními mikroplasty, které je dosud právně řešeno pouze nepřímou regulací, a to prostřednictvím omezování plastového odpadu jako zdroje tohoto typu mikroplastů. Cílem práce je především vytvořit přehled existující právní úpravy věnující se nakládání s mikroplasty na úrovni mezinárodní a evropské (včetně jednotlivých právních úprav členských zemí EU) a na základě tohoto přehledu provést analýzu této právní úpravy a formulovat návrhy a doporučení pro zlepšení nakládání s mikroplasty a zejména pro omezení jejich úniku do životního prostředí. Disertační práce je rozdělena do devíti kapitol: První kapitolou je úvod, ve kterém je řešeno uchopení tématu, výzkumné otázky a struktura práce včetně použitých metod. Druhou kapitolou je věcný úvod, který se věnuje úvodu do problematiky nakládání s mikroplasty, a to včetně současného poznání ohledně dopadů... Microplastics and plastics from a legal perspective Abstract The dissertation deals with the management of microplastics from a legal point of view, following the ever-increasing pollution of the environment by plastics. The issue of microplastics has not yet been dealt with at this level in the Czech environment. The dissertation is not aiming only at the management of primary microplastics, which is most often dealt with by existing legislation at the level of individual states, but also at the management of secondary microplastics, which have been so far legally dealt with only by indirect regulation (through limiting plastic waste as a source of this type microplastics). The aim of the work is primarily to create an overview of the existing legislation of the management of microplastics at the international and European level (including individual legislation of the EU member states). Based on this overview is made an analysis of this legislation and are formulated proposals and recommendations for improving the management of microplastics, especially to limit their release into the environment.
