Volný pohyb osob a pracovníků v EU a jejich vzájemný vztah Abstrakt Tato diplomová práce je zaměřena na jednu ze základních svobod vnitřního trhu. Jedná se volný pohyb osob a pracovníků, který vymezuje základní právo každého občana Evropské unie. Diplomová práce se na svobodu volného pohybu osob a pracovníků soustředí z pohledu teorie a praxe, s důrazem na judikaturu Soudního dvora Evropské unie. Předmětem diplomové práce je zmapování problematiky volného pohybu osob a pracovníků od samotného vývoje dané svobody, zavedení občanství EU a konsolidující směrnice 2004/38/ES o právu občanů Unie a jejich rodinných příslušníků svobodně se pohybovat a pobývat na území členských států, po samotnou definici pracovníka, až k aktuální podobě této svobody včetně náhledu do současné situace. Cílem diplomové práce je zaměřit se na svobodu volného pohybu osob a pracovníků z pohledu jejich vzájemného vztahu a porovnat jejich práva. Práce je členěna do 4 kapitol, kdy se první kapitola zabývá vývojem svobody volného pohybu osob a součástí je také podkapitola zaměřující se na občanství EU. V této kapitole je také upraveno právo pobytu občanů EU. Druhá kapitola se věnuje definici pracovníka včetně pojetí tohoto pojmu ve světle novější judikatury Soudního dvora Evropské unie. Free movement of persons and workers in the EU and their correlation Abstract This thesis is focused on one of the fundamental freedoms of the internal market. This is the free movement of persons and workers, which define the fundamental right of every citizen of the European Union. The thesis focuses on the free movement of persons and workers from the point of view of theory and practice, with emphasis on the case law of the Court of Justice of the European Union. The subject of the thesis is to map the issue of free movement of persons and workers from the evolution of this freedom, the introduction of citizenship of the EU and the consolidating Directive 2004/38, the definition of worker, to the current situation in the light of covid-19 crisis, that had a huge impact on the freedom of movement. The aim of the thesis is to look at the free movement of persons and workers from the point of view of their correlation and compare their rights. The thesis is divided into 4 chapters, where the first chapter is focused on the historical development of freedom of movement of persons and includes a subchapter dealing with citizenship of the EU.
