Problémy institutu vazby Abstrakt Institut vazby a problémy s ním spojené představují aktuální a významné téma rezonující v právní teorii i aplikační praxi. Na jednu stranu vazba platí za jeden z nejefektivnějších způsobů pro zajištění zdárného průběhu a účelu trestního řízení, jelikož její podstata spočívá v omezení osobní svobody osoby, o jejíž vině a trestu nebylo dosud rozhodnuto na základě zákonem vymezených podmínek, na druhou stranu vyvstává čím dál častěji otázka, zda tento tradiční trestněprocesní institut dokáže stále ještě obstát v porovnání s rostoucími garancemi základních lidských práv a svobod stanovených ať už vnitrostátním či mezinárodním právem. Cílem této diplomové práce je nalézt problémy, které s institutem vazby souvisí, poznat z čeho plynou a pokusit se najít jejich řešení pomocí již existujících či vlastních návrhů de lege ferenda. K naplnění tohoto cíle slouží čtyři kapitoly zaměřené na problémy vyšetřovací vazby. První kapitola předkládané diplomové práce vymezuje pojem vazby, její účel a také limity pro omezení osobní svobody vazbou plynoucí z nejvýznamnějších vnitrostátních a mezinárodních lidskoprávních dokumentů. Druhá kapitola pojednává o historickém vývoji tohoto institutu od roku 1873 po současnost, přičemž jsou zde zvýrazněny vybrané důležité milníky ve vnímání vazby s... The Issue of the Instrument of Criminal Custody Abstract The concept of criminal custody and the problems associated with it represent a relevant and important topic resonating in legal theory and application practice. On the one hand, custody is considered to be one of the most effective ways to ensure the successful course and purpose of criminal proceedings, since its essence lies in restricting the personal freedom of a person whose guilt and punishment have not yet been decided on the basis of conditions defined by law, but on the other hand, the question arises more and more frequently whether this traditional criminal procedural instrument can still stand up to the growing guarantees of fundamental human rights and freedoms established by both national and international law. The aim of this thesis is to identify the problems related to the instrument of criminal custody, to find out what they entail and to try to find solutions to them by means of existing or own de lege ferenda proposals. Four chapters focusing on the problems of pre-trial detention serve this purpose.
