Vliv nouzového stavu na posuzování trestné činnosti Abstrakt Diplomová práce poskytuje vhled do problematiky posuzování trestné činnosti spáchané za nouzových stavů během pandemie onemocnění covid-19 v letech 2020 až 2021. Cílem diplomové práce bylo zjistit, jakým způsobem je nouzový stav v trestním zákoníku reflektován, identifikovat problémy, které v této oblasti přinesla pandemie onemocnění covid-19, a z hlediska identifikovaných problémů zhodnotit právní úpravu a případně předestřít návrhy de lege ferenda. Trestní zákoník s nouzovým stavem počítá v základních skutkových podstatách třech trestných činů, dále jej řadí mezi obecně přitěžující okolnosti a nouzový stav může rovněž hrát roli při posuzování naplnění okolnosti podmiňující použití vyšší trestní sazby u devíti trestných činů. Vymezení zmíněné okolnosti podmiňující použití vyšší trestní sazby pouze u devíti trestných činů práce považuje za nesystematické, a navrhuje proto příklady dalších trestných činů, kde by okolnost měla být zahrnuta. Nouzové stavy a pandemie onemocnění covid-19 způsobily nejednotnost v rozhodovací praxi soudů. Soudy se neshodovaly v otázce potřebné míry souvislosti spáchaného trestného činu s výše zmíněnou okolností podmiňující použití vyšší trestní sazby, kdy se některé soudy spokojily se souvislostí časovou a místní, jiné... The Impact of the State of Emergency on the Assessment of Crimes Abstract The thesis provides an insight into the issue of assessing crimes committed during states of emergency during the pandemic of the covid-19 disease in the years 2020 and 2021. The aim of the thesis was to find out how the state of emergency is reflected in the Criminal Code, to identify the problems caused by the pandemic of the covid-19 disease in this area, and to evaluate the legislation in terms of the identified problems and, if necessary, to put forward de lege ferenda proposals. The Criminal Code provides for a state of emergency in the provisions regulating basic bodies of three crimes, it also includes it among the generally aggravating circumstances and the state of emergency may also play a role in assessing the fulfilment of a circumstance triggering the application of a higher penalty rate for nine crimes. The thesis considers the definition of the above-mentioned circumstance triggering the application of a higher penalty rate for only nine crimes to be unsystematic and therefore proposes examples of other crimes where the circumstance should be included.
